YES ONE MAY SURRENDER GSTIN - IN CASE -EITHER STOPPAGE OF ACTIVITIES FOR AN ENTITY IS CREATED OR FOR ITS WINDING UP COMPLIANCE AS PER IBC. HOWEVER AGREE THERE TWO ACTS THAT ARE TO BE TAKEN CONIZANCE OF- AS ADVISED BY MR. SANJAY. more
correct. both are different things and regulated by different legislations. It might be that business is out of purview of GST but still carried on. But, if closing of business activities, need to close the COmpany under Companies ACt, 2013. more
Company registration is different from GST registration so if you want to surrender or cancel your GST registration you can do it but at the time of cancellation of GSTIN you have to disclose the reason for cancellation of GSTIN. No need to cancel your company registration in the office of Registrar of Companies. Still have any query you may contact me at my mail id adv.sanjeevgoel@gmail.com or on mobile 9899390850 more
You are always welcome and if have any query please feel free to ask at any time and don't bother what others say as its human nature to poke their nose without knowing the facts or circumstances. I read your reply to Mr Padam Law. You can continue your company registration as to get the same name again is not possible and moreover for cancellation of company registration at ROC you have to initiate the winding up proceedings of your company so if you are thinking to surrender your GSTIN because of paying to your CA to file Nil returns you may contact us for free service of filing your Nil returns till your business gets momentum. more
I smell a suspicion there. Pl mind what you say about others without knowing the truth. I'm an iternational Edupreneur and during these last few months during the pandemic, there have been no students to send abroad. So it's not that I want to STOP paying GST, it's just that I'm fed up of filing nil returns and then having to pay my CA for filing that. Yet I want to save my company name so in future there is no problem if I can rede business again. more
