Take it from me-- ALL businesses are cheats! They always find dishonest means to become rich. I have filed some 27 consumer cases in the last 4 years for various types of unfair trade practices and deficiency in service. I won some 9 out-of-court; 12 in the court ; 4 are under appeal in the Commission, and 2 were filed just a week back. The reason is that our Consumer Protection Act 1986 is NOT being implemented strictly and the courts are not awarding high compensation and costs to the complainants. Even when the judgement debtors do not pay the cost and compensation during the 60 days period, the court does not penalise the JDR under Sec. 27 of the C.P. Act 1986. Several times I pleaded with the Bench that not penalising the JDR and not invoking Sec. 27 is harmful to the Complainant and causes great misery to the complainant, instead of punishing the JDR. The Execution Applications only increase the workload of the court. Regrettably, it never found acceptance by the Bench. I am very disappointed with such a state of the law in our country. I wrote to the Law Minister about a year back. I have yet to see what he does to overcome such harassment by the defaulting parties. There is no sense in awarding some Rs 3,000/Rs 4,000 cost and compensation (which are peanuts!) after some 12 hearings and then again attending 6-9 hearings in the E.A. The whole purpose of the C.P. Act 1986 to discourage merchants from cheating customers is defeated. It is the customer who is harassed and the defaulting parties enjoy seeing the complainants suffer to no end! more
The consumer court should not be allowed to give adjournment on behalf of the merchants. These adjournments are source of corruption. Time limit of disposal of cases should be adhered. Failing which the judge of consumer court should be suitably penalised. more
Why don't we all members submit a petition addressed to Law Minister & PM about the consumer courts mentioning all the grievances. In my opinion it may help. more
