Pl. ref. the recent Judgement of SC in case of NOIDA wherein relief is assured. You may opt similar course of actions, not necessarily only of SC but the Consumer forum/Commission, Civil and criminal, Rera etc. You are having multi-pal choice. more
cost of carrying inventory of unsold flats will screw the hell out of builders. more
I hope so. But the builders and the consultants/commission agents/property dealers have plenty of reserves with them to prolong the fight with the property buyers. They can hoard the property for pretty quite long time. The only solution is the new Insolvency & Bankruptcy Act that can guarantee build up flats or refund at the cost of the builders. more

First, two factors affect your exit-[1]EMI-payment of loan to bank, which have given you loan, you need to pay them back all money to collect what ever documents they have to lend you.[2]The non constructed asset-which the builder shall be in a position to identify and say they can give that/transfer full to you. This cannot happen, because many drwings-utilities might have been approved /licenced by the Municipal authorities. Lastly such property who will buy in the present scene-which also includes IT regulations-you need to stay with builder/get approvals, see that project is over[if all plots-flats are really booked. If not problem lies like the other builders who took in advance from bank with out booking all the[80-90% flats].I think you are aware of companies which are struggling like JP and others. more
Meghnaji, Please tell me whether you property is ready to move in or under construction. If under construction then what is the date of possession mentioned in the sale agreement with the builder. If under construction please check online for RERA registration of the project on rera website of your state or rather union territory of New Delhi. If your apartment is ready to move then you can sell it in the open market with the help of RERA registered agents or directly with any of your know buyers. If you need more advice then you need to mail me all the details regarding the purchase of your flat. advsheregar@rediffmail.com more
