Home Saaz

Dear Consumers, I am reproducing the content of a mail sent to Home Saaz for the kind information of the consumers planning to buy from Home Saaz. All are requested to share the copy of the bill wherein taxes have been charged.
" I had a visit to your show room at Crown Interiorz in connection with purchase of few items which were being offered on 40% sales discount.
It was surprising to see that you have been charging tax extra on the discounted prices and in view of charging tax extra, the effective discounts were not as was being advertised. I was also shocked to see that the advertisement says "VAT Extra" as attached herewith. It was shocking to have come across such an advertisement as the regime of VAT is no longer existing for the past more than six months.
Further, I was told by your cashier (was told name as Mr. Harsh Batla) that there is a notification to charge taxes on the discounted sales. The undersigned requested for a copy of the notification but he could not produce the stated notification despite request. It was promised by him that the said notification would be sent to me by email, the id for which was shared. It is regret to mention that the same has not been received by me till the time of writing this mail.
In case I fail to receive the copy of the notification by 6 PM today i.e 27th January 2018, it shall be presumed that there is no such notification and the taxes being charged are in violation of MRP rules and appropriate authorities would be requested to initiate the appropriate action as may be applicable including refund of the amount to the consumers as might have been charged. It is worthwhile to inform you that Hon'able National Commission has already adjudicated on the matter as unfair business practice in case the taxes are being charged over and above on discounted MRP.
In view of above, I request for
1. a copy of the notification as stated by you for charging of VAT on discounted MRP
2. Stop immediately charging the taxes VAT or GST on such sales in case there is no such notification of Govt. of India.
3. Arrange refund to the consumers from whomsoever it has already been charged in case there is no such notification as above
You are requested to kindly confirm the same by 6 PM today failing which I would be compelled to report the matter to the appropriate authorities as well as any other action that may be deemed fit including misleading of the consumers . Please confirm the same by return mail.
With kind regards" more

@ Shishir Kant ji, Sir, I had a visit to Pantaloon yesterday in Rohini West. The display board of discount says the discount is on MRP but GST would be charged on the discounted prices. At the same time I saw another advertisement board at Woodland which says 50% discount with no extra GST on the discounted prices. Now either the Pantaloon is wrong or the Woodland is evading taxes. My previous analysis which incidentally is also included in the judgment of State Commission and National Commission that the since the MRP is inclusive of taxes so the discounted price is also inclusive of taxes. Any additional tax so charged is illegal. This clearly proves that illegal trade practices are going on and the stakeholders are silent on the subject for the reasons best known to only the stake holders. more
I am in agreement with you. There is a confusion and erroneous displays of discounted price. Our legal system is sluggish and that is advantages to sellers. more
A helpful post by Mr Virmani. The subject matter is rather "sensitive" though, and one as complainant needs to tread carefully. Allow me to elucidate as follows: We too have been, though not so frequent visitors to Home Saaz in Lajpat Nagar. Yesterday's visit was with purpose to get confirmation of Mr V's experience in Ghaziabad/Faridabad. And we actually selected three items to buy. And now to our observations: 1. On all items we selected, the original price was indicated but the word MRP was not printed. And yes, the store was giving 40% discount on the price. 2. On the "challan" written in hand by the salesperson was mentioned the original price with 40% discount "plus VAT". Well, one may assume that VAT was meant to read GST. 3. The bill also shows clearly (a) the full price, (b) the discount amount, (c) the sales cost, (d) the GST amount payable on (c) and finally (d) the Net Amount payable. The question that could arise here is: "Would it be correct to assume that the price mentioned on the item is actually MRP, when on the price label the word MRP is not printed?" And, if not, would Mr V's objection be considered as valid? It's a learning process for us all. more
Good and true observations.

If MRP regulation is not applicable through matter is restricted to market sale price. more
Sure. We return to Delhi Wednesday and shall do the needful coming Thursday. In any case I had planned to do that. more
Sir, Can you see the price tag tagged with the item or printed on the item. I feel the price tag must be saying inclusive of tax or MRP. Is it possible to mail me the bill and scanned copy of the price tags. I am already struggling with Department of Consumer Affairs for the past more than two years for issue of notification. The Local Circle Manager is aware of who also is actively involved with DCA on the subject. more
I had the same experience at GlobalDesi, at RadissonBlue, Dwarka Sector 12, New Delhi. With 50% discount advertised, they mentioned `Taxes extra'. Sales person said this is Company policy. When I asked does your full price (MRP) include taxes or not? He said yes. So effective discount is not 50% if you are adding taxes extra to which he only said you can give feedback in form provided. I had to leave the bill with a relative because he will be collecting the item after alteration. When I receive the bill, I will share here, as well send complaint to Consumer Affairs Ministry. more
THE PROBLEM IS WITH OUR JUDICIARY SYSTEM OF LATE LATE & LATE, COMBURSUM, TIME, ENERGY & MONEY CONSUMING, TO THE APPLICANTS. THUS NO ONE WANTS TO TAKE SUCH CASES TO COURTS. AND THE COMPANIES/CRIMINALS/GOONDAS MAKE USE OF THIS ASPECT. more
The problem of corruption can not be linked to only one setup of Government like Judicial System termed you. In fact wherever Government bodies are involved more than ninety percent system has adopted corrupt practices and the values of compliance with Norms of Performance have been set aside. more
Virmani ji, Thanks for your initiative. more
