how much annual charges can be taken by RWA
I want to know that how much annual charges can be taken by RWA from the residents for Sector management. Secondly, are these charges payable by the residents only because there are schools, temples, shops, activity centre, hospitals etc. inside a sector. Are the owners of these institution are eligible to pay these annual charges to RWA. Greater Noida authority has divided the land in variuos categories like Schools ( NS), Hospitals ( NH), temples (R), facilities (F), secondary schools ( HS). pl. guide who else other that residents should pay these charges. thanks
RWA (Resident Welfare Association) is an old and generally used term which is now replaced by Apartment Owners Association in accordance with the enactment on this subject in Uttar Pradesh. The Board of Management proposes the monthly maintenance charges on the basis of actual costs being incurred and the General Body of AOA determines the charges which become binding on each resident or apartment owner. The terms and conditions on which the Builder hands over the campus to AOA determines the liability of charges on shops and other establishments within the campus. Unless there is any provision to the contrary, the AOA is entitled to determine rates for monthly maintenance charges recoverable from such establishments, which may be different, usually higher in terms of charges per unit area, than the charges adopted for residences.

To clarify Shri Rakesh's observations, it may be mentioned that there are completely two different aspects of (1) Society Maintenance by a RWA and (2) running of schools, hospitals etc. As for any Society, it is the RWA, a duly elected body of apartment owners, which maintains day to day management of the given Society. It is upto that RWA to decide Maintenance charges which are to be paid on monthly basis by flat owners. The RWA authority is confined to only that particular Society and does not extend beyond its boundaries. While there is no specified limit, RWA is answerable to General Body comprising all flat owners and as such cannot arbitrarily charge Maintenance. With respect to schools, hospitals, etc., these generally remain under control of the particular builder, who has built/developed the complex.

I do not think there is any specific procedure for calculation of Maintenance fees. The amount can vary depending on number of residences that would share the cost, the type and number of services provided, etc. and how useful and effective the services are. Managing committees of Welfare Associations usually have meeting of members to decide an discuss these factors.
