Ultimately you are terminating the employment. After that you can withdraw the PF. PF can not be forfeited in any way. more
HI, You have not provided the good reason for leaving without informing to your present employer. In case if you do so, then your PF withdrawal will be delayed because, in your withdrawal form employer has to sign and submit it to the department. (submission you can also undertake but signature has to provide by the employer otherwise PF department will not accept the form. Alternatively you can submit the form without signature to the department, in turn they will forward it back to your employer for sign and submit. At this time you may give a letter to PF department to help in obtaining the signature from the employer. Asocial security officer will help you out in this case. But, all this things will take time and consume your time also in this. Better you will properly inform and leave the organisation. Thanks and Regards, G.Kumar more
I am a senior citizen and drawing pension, I do not see anything wrong in asking 'Live Certificate", why it should be an harassment to anybody. In fact, this practice is an agreed practice internationally also. Govt is insisting 'Live Certificate' so as to ensure that the genuine pensioner receives his pension and gthe scope for misuse is eliminated. more
What is the link for your leaving the organisation and withdrawing PF. While in employment temporary withdrawal of PF is allowed on certain occasion and similarly partial permanent withdrawal is allowed on three occasions. You are not at all fulfilling these stipulations. Now you want to draw, this can be possible only after leaving the employment and after that not taking up any employment at least for a minimum period of two month. more
Dear Sir, Each month employer takes the EPF part, out of your salary and along with their contribution, deposit it into your EPF account with the EPFO organisation. Once they deposit it with EPF office, then it’s just your money and no one else’s. Your employer can not control it. However note, that your employer’s signatures are required on the EPF withdrawal form, to certify that you are not employed with them anymore and now you can withdraw the EPF. If you are unemployed, you will have to make an affidavit that proves that you are unemployed. Make Affidavit and get it printed on a Rs. 100 stamp paper with a notary or any gazetted officer signature on it. This is required because you need to be unemployed if you want to withdraw your EPF . If you are employed, you can transfer your EPF to your new employer. Here are 3 steps you need to do to successfully withdraw your EPF without previous employer signatures. Step 1 First download and fill up Form 19 (for EPF withdrawal) and Form 10C (for EPS Withdrawal) Step 2 Get it attested by any one of the following Manager of a bank (PSU preferred) or By any gazetted officer or Magistrate / Post / Sub Post Master / Notary Step 3 Write down a letter addressing the regional PF commissioner, stating the reason why you have to get it attested and how you are facing issues with your employer. In case you have any proof of unsupportive behaviour from your employer, better attach it. (This step is optional, and not mandatory) Send these forms to your regional EPF office and wait for next few months for some kind of action. Thanka Ashok B more
