I am Satya Pal Soni. I booked an affordable housing Flat in Sector 70 a Gurgaon (Urban Homes) . In their Demand letter they have added VAT. I totally fail to understand as to why VAT should be charged on the installment to be paid by me .Will some one tell me whether the installment for the flat under construction comes under the purview of VAT. Someone from the legal team may please help me.

Dear Mr. ASHOK KUMAR The Basic factor is to ascertain whether the VAT is actually applicable and Who is the ultimate Responsible for Payment. Presuming that it is the Buyer's Responsibility - Buyer can Pay directly to the Authorities and submit the Copy of the receipt to the Builder with Covering Note. In case of Builders/Developers Responsibility - it is him to pay that. Pl. review the Agreement minutely. Dear Mr. Babubhai Bhanushali, You had done the right thing as the Agents are making false commitments, which they are NOT supposed to. Now to get the payment back, issue the ICICI a legal NOTICE to pay within 15 days from the date of receipt of the Notice along with the Interest @18%, and if yoy do not received the same just file a complaint with Consumer forum, as well as cheating to the local police station specifically requesting for copy of FIR . Mostly your complaint will not get entertained bit will get lodged as NC. In that case file private complaint against all - including the Principal and the Agent. more  
i booked a flat in greater noida west, as per payment term, last 5% payment is to be paid on possession. but the builder has sent me the demand letter without obtaining completion certificate from the Greater Noida Authority, I have requested the builder to clarify/confirm whether it is legally correct to raise demand without obtaining completion certificate and also to clarify whether possession can be given prior to issue of completion certificate (CC). Builder has clarified that they have applied for CC to the authority last month and CC is expected in 2-3 months, however possession can be given before CC. So the builder has insisted to pay the demand raised now. Seek advice from the group members whether Builder can demand payment which is due on possession without obtaining CC and whether builder can give possession without CC. what action I can take if builder stand is not correct? more  
Government has been expanding the perview of VAT to generate more income, but they never extend any facility to the consumer, who pays the tax. Will the government think seriously on the matter. more
