Illegal lawyer tenant

My friend is a doctor and was proprietor of a nursing home in Bangalore. Their area got upgraded from Panchayat to Municipal Corporation and following that, the corporation undertook civil works in the locality, like digging five feet on either side of the road for drainage, changing overhead electric lines, etc, and due to that the hospital lost its water sump, and road access. Without proper access to the hospital, without proper water, electricity; he dragged on for nearly one and half year. Civil works went on at a snail's pace, despite him approaching the local politicians. His Bank payments started accumulating, and he had to take loan after loan, just to manage the existing loans without any income for more than a year. Finally, he applied for insolvency in the court and submitted all his assets including the hospital equipment, own house, and all household articles, in 2008. He was allowed to stay in his house in the first floor, and had rented out the ground floor for his day to day living expenses. A lawyer approached him on the pretext of taking the house for Lease. The agreement between them was that the lawyer will a pay a rent of 8000 per month for the first few months, during which time, he will arrange for the Lease amount and then sign the Lease agreement. Hence, the rental agreement was postponed. Even the rent advance cheque of X amount, which was presented to the bank after 3 months, at the request of the lawyer, that he is in difficulty, bounced. Now the lawyer started threatening the landlord, taking advantage of the insolvency proceedings, and bribed the police, and instigated his friends who used to come to the tenants' house in a drunken state, and abuse my friend, for demanding the advance amount. Even the police did not help him when he approached them. The lawyer tenant used to secretly ring up the banks' loan sharks and instigate them to come and illtreat the doctor's wife, when he was not at home. Finally, the family could not tolerate his antics, and went away to a rented place. The lawyer has not paid rent for the last 7 years. Now my friend's problem is how to vacate the illegal tenant? It is very easy to say but extremely difficult to face such anti social elements. I have come across the similar case in Pune where tenant has been enjoying the the house without paying even electricity bill what to talk about rent since last one year. the owner has been running from pillar to post ie police, judiciary etc but of no use. Toward the end it is the social circle which came to his help and forced the tenant to pay all the dues and vacate the house.Police and judiciary all are for the people having money,muscles and political affiliation not for the common man. more  
Is there a paucity of lawyers or legal advisers in Bengaluru that your doctor friend has completely surrendered himself to the wicked lawyer from the very beginning without consulting one and had been waiting for prevailing of good sense in the mischievous man who had occupied his house with bad intention, for last 7 years? It is very interesting that he himself had vacated his own house instead of proceeding against the person who is illegally residing therein and creating all kind of nuisance to force the landlord himself to leave. It is utter foolishness. He should have immediately on the tenant's failure to fulfil his commitments, approached the court to get his house vacated. However, late is better than never and he should immediately lodge a FIR with the local Police Station and file a suit in the civil court for vacation of the house. As far as the cheque is concerned, which was bounced on tendering for payment, he has lost the opportunity of lodging a criminal case against the lawyer under Negotiable Instrument Act. The case has since become time-barred. more  
MR GOPAL KRISHNAN , I M REALLY SURPRISED HOW UR FRIEND DARED TO ENTER INTO CONTRACT WITH AN ADVOCATE. BCOZ IT IS WELL KNOWN FACT THAT ADVOCATES R D WORST COMMUNITY THAT STANDS TO ANY COMMITMENT OR THAT ABIDS BY LAW. THEY R D 1ST OR VERY HIGH CLASS LAW BREAKERS. U'LL OBSERVE THAT MANY PROFFESSIONALISED BANKS AS A MATTER OF POLICY DO NOT GRANT LOANS TO ADVOCATES OR MANY PARENTS WILL NOT WANT THEIR WARDS TO BUILD RELATIONSHIP WITH ADVOCATES. NOT THAT IT IS IMPOSSIBLE TO SUCCEED AGAINST AN ADVOCATE BUT IT IS VERY DIFFICULT, AND THE TIME AND MONEY INVOLVED WILL OUTSMART ALL UR ABILITIES. THAT IS OUR SYSTEM PREPARED BY ADVOCATE LAW BREAKERS SUITABLE AND IN INTEREST OF RICH CRIMINALS. more  
The court needs genuine owners documents to prove that the house belongs to him & Tenent is illegally occupying the house if really the lawer tenent harassing the owner & made him to leave his own house ! The court will help him to get his house vacated he can approach free legal cell & get advice more  
Honourable Courts will certainly protect the Law abiding citizens from the hands of corrupt Law breakers. more
