Improving the Judiciary - Critical Inputs Needed
The Constitution of India has been amended to provide for establishment of National Judicial Appointment Commission (NJAC) and the associated act will regulate the procedure to be followed for recommending persons for appointment as Chief Justice of India, Judges of Supreme Court, Chief Justice and Judges of High Courts and for their transfers.
The Commission is to be headed by Chief Justice of India and will include 2 senior most judges, Minister of Law and it is proposed that 2 eminent citizens from the civil society be appointed to NJAC.
The idea behind appointing 2 eminent citizens from civil society is to make the system broad based, transparent, fair and objective.
In the current scenario, all appointments of judges is decided by the judiciary itself and the civil society has no say.
We would be conducting a poll on this subject separately seeking your views on whether you support the inclusion of 2 eminent citizens to this commission.
Separately, we will seek your views on what should be the definition of "Eminent Citizens" as far as this commission goes.
