Indian Univ. vacancy and its realty

Dear all- I would like to share a very important topic which is related to the Indian state and central government universities advertisements for faculty and other academic positions and its realty. I seek your legal advise and also look forward to seeing your comments and suggestions.

Let me share experience here:
I have been seeing that universities are adverting faculty positions using different online and offline channels. Most of the Indian state and central universities asked for a certain of amount of application fee (which vary from INR 500 to 3000) in the form of DD or through online payment. We as an applicant applied for a job but we never receive any response after passing several months. Then suddenly we see another advertisement for faculty positions from the same university without any recruitment from their perviously advertised positions. What I found that this kind of business is growing in Northern Indian Universities, they just advertise the positions and make crores of money and cancelled the vacancy without informing the applicant and readvertising the same vacancy with little modifications again and again to make only the money to not filling the positions. Its been happened several times with me and others as well and now a days its growing much more now.

My questions are listed below:

1) Is there any official governmental body who really monitor this kind of thing ?
2) How can an applicant get his money back if the universities are cancelling and delaying the recruitment process without any valid reason? if not then what they do with crores of money?
3) How can government control this kind of practice?

1. The Ministry of Education - Central & State - are the governing bodies. 2. Unless it is specifically specified one can not get the fees refund. To get it refunded you have to knock the door of Court - preferably by way of PIL/Writ so the entire group/Community of applicants - not restricted to individual - will get benefited and such practice in present manner will get restricted by way of directives. 3. Factually, Govt. does not control such practices that is why it prevail and growing. more  
is there a centralized accounting and audit mandatory for the positions advertised, filled and so on.....pathetic state of affairs!!!!!!!!!!!!!!!if academic institutions can do this, ethics for corporates and NGO and trusts and the list goes on for unaccountable transactions and bad or no auditing! more  
It is not a simple issue of refunding the fee paid by the applicant. There are bigger issues behind it. Why should the advertisement be repeated with minor modifications? Have you ever thought about it? The appointing authority of the university faculty is the concerned VC. He can appoint a person of his choice through his own selection committee constituted by him. He is only answerable to the education minister and the Governor of the state who are pro-chancellor and Chancellor of the university. The VC is appointed by the Chancellor on the advice of the state government. Now tell me whether these appointments can be done properly and with honesty. The starting pay of the AP in an university is at least on par with the entry level IAS Officer. Can the Cabinet Secretary appoint an entry level IAS probationer directly without the selection of the UPSC? When this is a case why should the VC be allowed to appoint an AP without consulting UPSC, as UGC funds the universities? Is it not fair to ask the UPSC to conduct a national level competitive exam for selecting the APs who are almost equal to IAS entry level officers in salary and status? Will someone in the ministry of HRD think about it? more

GST is applied to competitive exam forms. more  
And education is out of GST purview (0% GST). more  
My dear folks, whenever there is any government body involved, just don't trust. Simple rule. We are in a poor state of affairs because of these conniving babus and the netas. Both are USELESS no. 1. In Mumbai's recent railway bridge tragedy, Mr Goyal displayed himself very poorly, he is absolutely unfit for the job. If Mr Modi does not know this and still wants to pursue his outrageous plans without any homework, leading to nothing, he will go down in the history as a stupid PM, next only to Muhammad Tughalak. He has already proved to be an epitome of an inefficient politician. He is not an intellectual in any sense. When you have to give lectures (Bhaiyao aur Behano type bullshit), it means you know you are doing nothing much. more  
Yes,the overseeing body has no permanent staff.Depenedent on the near university staff.For UGC and AITUC it is same. Highly corrupt,no intelligence no hard work.No proper basic degree.SUCH ARE THE STAFF WHO OVER SEE SOME FUNCTIONS OF THE UNIVERSITIES. more  
Hi- Transparency will come at later stage if the selection process will take place. What universities are doing simply advertising the positions and making money and after few months readvertisement the same positions without any recruitment from their perviously advertised positions. Firstly, Universities should send a call letter to the shortlisted applicants and call for talk and interview and officially declare results via news papers and also inform via email or by post. more  
The same thing happened to me also. There is no transparency in appointing such positions. more
