Inefficient judiciary, hopeless consumer forums
5 years back I filed a case in shalimar bagh consumer forum and I get only dates after ever 6 months. Most of the time judges dont come or the other advocate dont come. looks like a nexus . Today was the date and no judge came due to Id which was yesterday. My date was yesterday and changed to 13th and on 13th they made it a holiday. It is judiciary who is responsible for no consumer care and worst is Kejriwal who has no control on consumer forums. Better close these forums so that people dont live in fools paradise more

Dear Rajiv Bhargava, I am not sure the reason you approached the consumer forum, i am sure the reason has to do with something you purchased and you not being satisfied with the product/Service or so on. I ask you a simple question, is there an element of cheating in your case, do you think you have substantial reason to believe that you have been cheated. And in case you have been cheated, I would suggest you to file a cheating case against XYZ those parties involved in cheating you (Section 415 IPC give you the meaning of Cheating). I have in the recent past filed a case against M/s.Shopclues.com and cognizance has been taken, the stage of the case is summons to the accused. Fact is I ordered for something online through their website and what was sent to me was a used piece. I requested them to send me a identical product as displayed on the website, They did not, Hence the cheating case. I strongly believe that people doing business who take consumers for granted should be taken to the Criminal Courts if they indulge in acts of cheating and not consumer forum's. Because there is no penal action in consume courts. I am sure if there is an element of cheating involved in your case, you can still file a criminal complaint in the magistrates court, but do seek a Lawyers opinion with regards to time limitation, as you have mentioned that you filed a complaint 5 years ago in the consumer forum. My sincere suggestion to all is that to file criminal complaints either in police stations or private complaints in criminal courts against acts of cheating by insitutions, businesses etc... more

I support all the views expressed. I, myself, being an advocate have to appear before the CDRF (CONSUMER DISPUTES REDRESSAL FORUM) many times. It is a fact that sometime it takes years to get an order in a dispute. I understand that the members of the CDRF are appointed by the State Govts as per their whims and fancies. Though there are certain guidelines, it is always the affiliation to the ruling party. It is a privilege of the Ruling party to give some reward to some one who had 'worked' for the party! This should be changed. The CDRF members should be qualified with good social standing. (ii) Yes, the cases getting postponed for years together. There are several reasons,but the main reason is the absence of the FORUM MEMBERS. The advocates may ask for adjournments once or twice, but normally the case is posted for statement, counter statement, production of documents, additional documents, witness examination etc. And finally when the arguments are over, it is kept for orders. I have seen cases 'kept pending for orders' for months together! It all contributes for the delay. There should be a Govt. with a will power to help the consumer, then only things can and will improve. more

This is also one of the ground fact of Political influence that ruined the whole concept of Principles of Rule and even challenging the Guarantees contemplated in the Preamble of the Constitution.
Even the Supreme Court direction through {1996} 2 SCC 243 notifying that ' every Limb of Constitutional Machinery is to be People Oriented ' is also challenged by these Bodies . There is absolute need to move the Supreme Court for enforcement of true concept of the Preamble of our Constitution please . more

WHEN SALMAN THE CON'S CASE WAS FINALISED WITHIN A YEAR OR TWO, THOUSANDS OF OTHER URGENT CASES OF SENIOR CITIZENS HAD BEEN KEPT PENDING FOR DECADES. WHAT KIND OF JUDICIAL SYSTEM IS THIS ??? HIS ADVOCATE IS SAID TO HAVE CONVINCED THE JUDGE THAT THE ACTOR REQUIRED AN EARLY HEARING. IN THAT CASE , THERE SHOULD HAVE OBTAINED A RULING, FROM THE HIGH CORT, THAT WHENEVER SUCH A "HIGH INCOME CELEBRITY"S CASE" NEEDS EARLY HEARING , FOR FINANCIAL REASONS, THEN THE CELEBRITY SHOULD INVARIABLY DEPOSIT NOT LESS THAN Rs. TEN CRORE IN THE PRIME MINISTER'S RELIEF FUND. THIS IS WHAT JUSTICE IS ALL ABOUT. INSTEAD , THAT CON HAD OBVIOUSLY BRIBED THE JUDGES (JUDICIAL MAFIA) WITH* LAKHS AS BRIBES , FOR AN EARLY HEARING.
