Inquiry by Police
Dear All, Can anybody please confirm what is procedure of doing any general inquiry by local police inspector.
I am resident of sector 49 Noida. Today one inspector visited our house around 11:30 a.m when by mother was there, he enquired regrading some person whether he is living there, she denied. Inspector asked by mother to write a letter that that we are residing in this house since when and so called person in not living here .
She told him that she can't write this now he should come either on Sunday or in evening when some male member is there in house and talk to them, he said he can't come on Sunday. He further said please make sure to write this letter by evening.
My question is what is law in regard to inquiry made by police officer and what are our rights for the same.

Be Curtiss to police official,don't open the door .and politely ask or tell him that these r days of terrorism so u r careful. As per law (Sec. 161, 162 Cr.P.C.), police cannot ask/force any person to sign on any statement/information given by him/her. If the officer is asking/insisting on giving a written and signed statement, you can report the matter to SSP GB Nagar on his Twitter handle. UP Police has also recently launched twitter handle to resolve grievances. If you still face harassment, bring it up to the notice of District Magistrate, GB Nagar and District Judge, GB Nagar. more

Thanks a lot everyone for your valuable advise. He came again today, he has shown us warrant from Kanpur in name of that person for whom he was inquiring. He doesn't give us anything in writing but want us to give him a letter with regard to that person. We had submitted the same, as he was insisting for letter to be submitted by today itself as report has to be submitted in Kanpur court. But I really feel that there should be proper procedure for the inquiry to be done by any government servant, they should not misuse there authority/power..... more

In my opinion, the queries by police can be asked from police in writing also with the details of inquiring officer. It can be confirmed with station also. more

Police can definitely conduct such inquiry but cannot force old lady to write as the Inspector demanded. The best solution to this problem is to contact the local Thana of your jurisdiction and write and letter to them informing the said visit and send copy of SSP and DM. This shall ensure whether the person who visited was actually a policeman or someone else. SK Mathur more
