it is true that many IRPs have made fortunes in the process. When a company is handed over to an IRP, it becomes NO MANs LAND. IRPs have taken huge bribes to allow the promoters to remain in control the management and sold materials worth crores of rupees without bill for almost one year. The IRPs had also taken money to pass on the details of the plant and offers to the prospective buyers and the existing promoters. When the SBI chairman took a bold stand to disallow the existing promoters to buy the defaulting unit, the promoters were left high & dry otherwise almost every promoter would have bought the company at throw away price thereby legalizing the siphoned off money out of the loan amount. he CVC, State Vigilance and the Bankers have miserably failed in discharging their duty and gathering information about the illegal activities of IRPs and promoters of defaulting companies and needs to be invested by CBI without further delay. THE NCLT/NCALT
are moving at snail's pace as these are headed by Judges who are
known for inefficiency and under performance. Take the example of
BEDT RECOVERY TRIBUNALS. They have ruined the banking industry
by passing stay order and unlimited adjournment to loan defaulters.
These DRTs had become epitomes of corruption and inefficiency and
must be disbanded at the earliest. more

As I have mentioned elsewhere, the entire country is in a cobweb of corruption. All the instruments created to showcase the govt's "earnestness" in regulating the economy and root out corruption are actually established toperpetusate corruption and the political elite's greed for more wealth and the corrupt bureaucracy's endless craving for more power and wealth too. As regards RAAJESWARI RAAJESWARI's point regarding her wish to participate in the governance, I gave up my attempts long back! No one is interested in India to help the country--but only to loot it. more

THE ONLY REMEDY TO THIS BAD PRACTICE IS TO WITHDRAW THE EXTRA ORDINARY POWERS GIVEN TO BANKS UNDER SARFRESI ACT RATHER THERE SHOULD BE AN ARBITRATION COMMISSION WHO SHOULD CONCLUDE THE CASE WITH TRUE FACTS AND HONESTY OF THE PROMOTERS. THE PRESENT PRACTICE IS SIMPLY A LEGAL FORMALITY BASED ON THE DOCUMENTS WHICH MAY BE FABRICATED.COURTS DO NOT HAVE TIME TO STUDY THE CASES IN DEPTH. more

The statement is very correct and it is a common practice with the bankers to grab property of the promoters of industrial unit by declaring their accounts as NPA and property in crores are handed over to their favorites with hefty amounts but are not credited to the accounts of promoters to nullify their liability. The DRT mostly speak banks language.One example is of Japji Fabricators,Haryana. Their property of more than two crores have been seized for a loan of one crore five lac and still filed a recovery suit for 1.3 crore. The promoters were not aware of these legal complication and the bank took advantage of the same. If CVC wants to make a probe all documents in support can be given. more

I fully endorse views expressed by Rana ji. A big fraud is going on in the garb of shifting bad loans to ARCs and IRPs to clean bank Balance Sheet. Where as the CMDs donot accept even realistic and reasonable compromise proposals of promoters fearing backlash by Govt or or agencies but sell the assets to ARCs at throw away prices and promoters in turn purchase these assets back after paying some premium to these conduits. There is word in the market that highest level of corruption is going on at the behest of Ministry. In turn the small business men who suffered genuine losses due to circumstances beyond their control are being cornered and not allowed least concessions to revive them back. Thus small units are being wiped out of business. These units are in fact the back home of any developing economy. I call upon the PMO to intervene in the matter immediately to stop the rot. more
