“₹6 lakh relief 24 years after child loses thumb
Almost 24 years after a Ghatkopar-based oneand-a-half-year-old boy, admitted for high fever to Rajawadi Hospital, lost a thumb due to the negligence of the doctor and staff, a district forum on Monday ordered the hospital and the doctor, Dr Ullooppee Shah, to pay him a compensation of Rs 6.25 lakh.
Saif Shaikh’s hand had turned blue after the IV administered through the night was not monitored by the doctor and the staff, resulting in gangrene setting in eventually.”

Consumer Forums were started to give speedy relief to consumers. It took 24 years for District Forum to deliver order. Now the case will go to State Forum and thereafter to National Forum. So perhaps it will take another 48 years.

We request Local Circles to conduct a nation wide survey of cases pending before Consumer Forums and present the data to concerned Ministry. more

Sir, I have a feeling that Judges and Lawyers do not want quick disposal of cases as they think that would reduce their importance. At the time of Aurangjeb and Shivaji problems between two citizens were resolved immediately in one sitting or occassionaly in two sittings. Major reason was that there was no middle man in those days, Lawyers as they are called today. and there were not such along chain of Courts and Appeals as of now. The application was to then Supreme Court of that time i. e. King. Now generations come and go but case continues. (1) Particularly in Civil disputes, Applicant MUST submit all documents in support of his Plaint along with no. of witnesses he proposed to record and Non applicant also MUST submit his complete defense with all supporting documents and no. of witnesses proposed to be examined. (2) The date of hearing is fixed in consultation with all the stake holders i.e. all litigants and their advocates, and the Court. (3) The agreed date for hearing is firmed up and is postponed only in case of death of one of the stake holders. If any litigant or his/her lawyer is absent for any reason (except his death) the case shall proceed in absence of such litigant/advocate. If the judge is absent for whatever reason (except his death), State shall make arrangements for proceeding with the case or compensate all attending litigants for their expenses (T.A. + D.A.), loss of wages etc. (4) Maximum period for settling each category of case should be set and assigned some marks (as per complexity). Every Judge has to score a minimum set marks. Additional marks scored gets him bonus and any shortfall gets recorded in his/her service card/record. Any case reversed in higher court is treated as - two cases of that category. His/her annual increment is also based on his/her performance. (5) Stages of appeals should not be more than 3. (6) Losing litigant should be penalised to pay the cost of opposit litigant and State. (7) False Statement by a Witness or any litigant should be punished in the judgment of the same case- there should be no need to have a fresh proceeding for it. (8) The judgment MUST be a speaking and reasoned judgment. (9) Judges should also be accountable for their actions and ommissions to higher Court. (10) More high court benches be introduced for speedy removal of backlog. Most of the Civil suits shall be resolved in a year or less. More concrete proposals are welcome. RYK more  
It is not uncommon in any court in the country that the cases are disposed off within a span of an year. May PM Modi must come out with a mission as his pet project to give speedy and real justice, then only, probably, cases will be cleared within a time frame. more  
In India Justice is most delayed - It is more delayed if it Involves Political Leaders. Our Judiciary is unfortunately most corrupt more  
There is a saying "justice delayed is justice denied". The provision in our law should be changed, with a time frame for disposal of a case. The Lawyers should not be allowed to drag the case by requesting for time. more  
Judiciary need to have accountability. They can not be above law or below law. Being a citizen of the country it is their duty to devise procedure and methods to ensure natural justice to all. more  
यह इंसाफ़ नहीं हो सकता है - वैसे भी न्यायपालिका अब अपनी विश्वसनीयता खोती जा रही है और जब तक लम्बित मुक़दमों के लिए न्यायाधीशो को उत्तरदायी नहीं ठहराया जाता है तब तक इंसाफ़ भी VVIP/VIP के चौखट पर खड़े दिखेंगे - यह भी विडम्बना है की वे कार्यपालिका के काम में दख़ल देंगे पर जनता द्वारा चुनी सरकार उनके काम काज में दख़ल नहीं दे सकती है ?इतना ही नहीं उनकी नियुक्ति वे स्वयं करेंगे - क्यूँ नहीं कोई आयोग उनकी नियुक्ति करता है ? more
