Thanks to all of you gentlemen. It was very nice of you all to inform me about the filing of belated returns. I have received a notice from IT DEPT last week. Since I am away from home for some time and will return only after couple of months. In fact I talked to my auditor abt this. He said that he will look in to this matter until my returning home. Incidentally my annual income for the year 2012-13 may be less than 350k. Hope I will take about the matter. more

Mr. Sanjeev Goel: Your understanding of word "voluntary" differs from mine and difference in opinion is arising from that. By voluntary, I do not mean "unilatelral". For example, if an individual has refund due to him, he can apply for condonation of delay under section 119(2)(b) of the Income Tax Act. After he gets the approval for condonation of delay, he can file a belated return and refund will be made to him. In case, tax is still outstanding for any past year, it would be again advisable to take action voluntarily, take permission and file return rather than be hauled up for evasion of taxes by waiting for a notice. Being a tax professional you should be in a better position to provide information rather than taking a rigid stand that an individual can not even approach the authorities voluntarily for rectification of his own omissions and wait for a notice. more
Dear Ashok Golas....again you are not understanding the fact and misleading the person who has raised the query regarding belated return. I have not answered that you may file belated return voluntarily. I am again saying that belated return can only be submitted after receiving a notice from Income Tax Department for not filing the return for any previous year which is time barred now. Even now if you do not want to understand the point then you may try by filling any belated return voluntarily with out any notice and see the result whether it is accepted by the department or not. more
