I've left my job in the month of Dec 2016 and the organisation got me signed the full & final settlement after I had submitted the relevant documents to calculate my Tax to be deducted from my final settlement dues. Once submitted, I was paid my dues with a relieving letter stating there is NO DUE from either sides. However, the organisation is now claiming of deducting less TDS during my settlement and asking me to pay the amount (Rs72K) through various official communication. Please advise if I am liable to pay them for their miscalculation. I will be grateful if you can advise me on this. Thanking you in anticipation. Warm regards more

Tell your ex-employer that the balance of income tax payable by you, if any, will be paid by you directly while filing your Income Tax Return, obtain Form 16 from them and file the return in due course. Once you have left the job, their liability for deduction of TDS is over and now you yourself is personally responsible to pay correct income tax. more

Declare your correct income while filing Income Tax return and pay tax accordingly. Might be, your ex-employer is demanding money on pretext that, they failed to compute correct TDS at the time of Full & Final settlement. They might be trying to avoid penalty, if any, for wrong computation and deduction of TDS and depositing the same with tax authorities. more

I suggest you ask your Auditor to check your accounts thoroughly, and if there is genuine mistake /miscalculation by your organisation and If it is true, you can pay arrears directly to income tax departmernt.(check with your Auditor)If they had already paid to the income tax department you have to pay them. more

Do NOT Pay your employer - there's no way of knowing whether or not he'll deposit it. You can deposit the shortfall directly when you file your returns. Your employer is required to give you a TDS Certificate to the extent he has deducted Tax. more

You check up with your CA and if its needed as per calculation you have to pay eitherway. more
