Judiciary needs selection through competition
When ever a person completes degree in law, he tries to start his practice. Many lawyers succeed in the profession and become successful. They do not want to take up the paid job of judicial officer/ judge. Those who fail in the legal profession try to apply for the job as Judicial Officer/Judge at the lower level. By dint of hard work or seniority they get promotion to higher level. But the inferiority complex vis a vis successful professional lawyers remains.
In India, we have NDA Exam for direct recruitment of young Army Officers through national competitive examination. We have civil service examination for selection of best Officers in civil service, we have very tough examinations at all India level for selection of best students for medical profession, Engg profession, Chartered Accountancy etc. Unfortunately there is no All India level test for judicial services for selection of best professional judges, who can stem the rot in judicial system. Why can't we have a system where in best students are selected for judicial services after 12th Standard or after passing LLB through All India Competitive Examination? They can be trained to be efficient judges who do not have a handicap of inferiority complex. Whether law fraternity will allow this revolutionary change?
In every case before the honorable courts for selection of candidates for promotion, they demand that there sould be transparent system of selection duly notified. the promotions are nullified if proper and transparent system is not adopted. How ever for selection and promotion of honourable judges there is no transparency for the selection and promotion. An honourable judge who is not promoted will never know why he has not been promoted and what is expected from him to get a promotion.
Unless things change in our judicial system, common public has to suffer. more
