JUSTICE DELAYED : JUSTICE DENIED
Case 1: Four Years
2 get 1-year jail for stalking WR commuter
Nearly four years after two men were nabbed for sexually harassing a woman in a WR local by blowing kisses, making lewd gestures and stalking her, a magistrate court sentenced them to one-year simple imprisonment. Sunil Sarfare (52) and Prashant Darge (30) had targeted the woman when she entered a general compartment of a Churchgate local around 10pm.
Case 2: Eleven Years
4 convicted for ’08 Jaipur serial blasts that killed 80
Eleven years after 80 people were killed and more than 170 injured in eight successive blasts that rocked Jaipur on a May evening, a special court on Wednesday convicted four of the five accused and held the banned Indian Mujahideen (IM) responsible for the attack. The fifth accused, who was the first one to be arrested in the case, was acquitted.
Case 3: More than Seven Years
Justice Awaited
Nirbhaya case has dragged on for too long, judiciary needs to be faster
Given the horrific brutality of the case, the Nirbhaya gang rape and murder had shaken the conscience of the nation. But in an open and shut case such as this one, the wait for justice has been too long. If such a high profile case can’t reach finality even after seven long years, then the law can hardly hold much deterrence value.
The Nirbhaya gang rape and murder fell in the rarest of rare category. And right from the trial court till the Supreme Court, the judicial system rightly upheld the death penalty for the convicts. But review petitions filed at different stages with the Supreme Court have delayed justice at least by two years. This only reinforces the perception that the wheels of justice move excruciatingly slowly in this country. And if the accused happen to be politically powerful, things can be even worse.
Therefore, there is an urgent need to speed up the judicial process and reconsider review petitions in heinous crime cases when conviction has been upheld from the trial court till the apex court. The tareekh pe tareekh mindset – courts issuing date after date – must go.
Government needs to amend the Criminal Procedure Code and Laws for heinous crimes of Rape and Murder:
1. Death penalty only, No life imprisonment
2. No appeal allowed beyond High Court
3. No Mercy Petition, No Review Petition, No curative Petition
4. Hang the Rapist/Murderer within a week of sentencing
5. Do not allow adjournments for any reason more
