JUSTICE IN INDIA
Dear All, from the post I have seen that all the persons who had suffered without justice are of the opinion that the Legal Justice requires to be completely renewed. I therefore request express their view on how to achieve a goal of clean, affordable, fast & correct justice for all without any discrimination on cast, religion & financial status. My views are:
1. Final order must be delivered within 12 months from the first hearing date.
2. Presently many judges rely on past judgement. This one the most horrible way. The Hon. Judge do not know on what ground & circumstances the earlier judgement was delivered, Many Advocates takes disadvantage of such an order & twist the same.
3. There are many wonderful & clean Advocates who are the real Officer of court & helps Hon. Judges to deliver justice. But there are Advocates who will go all way out to twist the matter which is far away from the main issue & takes monitory advantage from their client who are guilty beyond any doubts.
4. One more solution is that BOTH side should be first heard directly & made to appear in person without any advocate, before the Hon. Judge &/or a jury. Some had a reservation that in village some people who are illiterate, cannot speak before the judge, I say that in fact those people will speak before the judge the truth.
5. Finally there must a cap on the charges made to client.
I now request your opinion, I thank the moderators of local circle, because of whom, we are able to express. I pray that Justice in our democratic India sets an example to the people in the world. more

Courts are like shopping malls. Pay more to get more. The only thing that talks is money and power. Nothing else. More than 995% of the population of the country do not go to the courts. Because the courts are of very little use. more

if u keep crying then future generations will also have to keep crying. the mess is due to ineffective judiciary. our judiciary allows absolute authority and impeccable immunity without any explicit accountability on to judges/advocates which is being exploited to make earning out of grievances by advocates. the merits of the case have lost priorities and other manipulation have bcom important. Judicial reforms fastening responsibility of advocates/judges to strictly adhere to rule of law otherwise punishable for aiding injustice is the need of hour. i have prepared rough petition " Indian Judiciary kills" which ull find under petition. If u fine it proper then u and ur friends may please sign it and we will pursue the matter to logical ends. more

All the points are a wish list of million of Indians. However, till such time very fundamental changes are brought in the system with a positive mindset and integrated approach. The judges and lawyers in all the courts would first have to be ordered to get out of their British legacy and be practical in their approach to clear the matters the poor litigants speedily rather than their wasting their time on mundane issues pertaining to rich and corrupt. Governments both in states and centre must adopt a reasonable approach and avoid rushing to the courts to cover their inefficiencies in drafting clear legislation. more

Agree with point 4 in your post and what Mr. Prasanta Misra has posted. But this is all wishful thinking unless some drastic action is taken by good leadership. more

Whenever a judgement results in a significant new interpretation of the law it must be vetted by an independent agency and incorporated in the footnotes of the relevant legislation.... Aided by digital automation such an approach will help a clearer understanding by all stakeholders especially the judiciary more
