Kudos to High Court of Karnataka for Delivering Justice in Just 48 hours
UGC had directed all the colleges in July 2020, to conduct Final year degree exams with a rider that those who cnnot write any exam for whatsoever reason will be given another special exam and will not be treated as absent. further the UGC Order said that such students will not be put to any inconvenience or disadvantage. Sharat KV a final year B.Sc student of St. Philomena's College, Putturu, could not attend one paper, on 3rd Oct.2020 fearing Covid, as he had slight fever. He had appeared for PG Common Entrance Test (MBA), conducted by Karnataka Examination Authority, under the Ministry of Education and secured 137th Rank. His final B.Sc one paper special (re)exam were scheduled on 7th Jan.2021 In the meantime KEA called for verification of Documents on 13/12/2020 and Sharath was denied document verification as he had not passed one paper in final B.SC. HE also missed out on MBA seat allotment which took place between 24th and 27th Dec. 2020. Being aggrieved Sharath filed a WP under Art. 226/227, in the High Court of Karnataka, making Secretary Higher Education as R1 and MD, KEA as R2. The application typed in green legal size sheets as per the format along with all the annexures and the affidavit were signed by him and mailed to High court on 28th Evening. It was accepted by the High Court in spite of there being a few minor technical objections, as WP 15600 of 2020. The fees we as later (on 31st) paid online. Sharath requested for urgent hearing and the High court posted case on 30th Dec. HE was heard on line and Mr. JUSTICE M. NAGAPRASANNA passed an interim order directing the KEA to permit the petitioner to participate in the Documentation verification process subject to this final results.
