Legal Advise
I was working in an automobile company at Dealer point in 2013, a customer filed a case in Distt Consumer Court. Party 1 Manufacturer, Party 2 Dealer & Party 3 Sales person. The Customer won the case at Distt Consumer Court and later Dealer appealed in Panchkula High Court but at High court he was defeated by the Dealer. Customer appealed for Supreme Court. I left that job in 2014 when case was running in Distt. Consumer Court but never went to court because the Dealer hired advocate attending all the dates everything. but now i am servicing in other company and the customer contacting me again and again to give statement in his favour, saying " Public Notification in national news paper or electronic media will be released for your name & Police may be arrest you as you will not attend the Date."
Although i have not received any notification from court or advocate, also not from Dealer.
Please suggest what should i do as per Law. more

Unless you receive a summons from the court you need not attend it. You may file a complaint with police for harassment and threats against the customer. And you can tell him same when he contacts again. more

Public Notice by printing in newspaper can be done only with the permission of the judge dealing with the case and to summon a respondent who is evading service of notice or evading appearance. Are you one of the respondents? Have you received any legal notice detailing the matter and seeking your side of the case? Have you received any summons at all from the Court? If not I fail to see how the threat of the consumer should be cause to worry. You are not a person who has committed a crime and absconded. Only if the summons is received from the Court should you arrange to be present and file an affidavit stating the facts of the transaction honestly when and if demanded by the Court. You could also consult the Dealer directly to ascertain the factual position. You should ensure that you are not sought to be embroiled in the matter by the other parties to the case. In my view, there is no relation between you and the consumer directly and hence you as an individual cannot be implicated. You have transacted the business only on behalf of the dealer or the manufacturer and hence your implication as an individual in the sale transaction cannot be sustained. You have to provide full details of the complaint for any specific advise. more

The Third party is the sales person as per your information.If that was you,how and what is the case is important.Then an advise will suit you.2.You need not align with consumer/or get in touch with him.That will be unethical and you may caught by the dealer.[You can align with the consumer-if you feel the product is bad-in the court as an approve] more
