Legal advise
Can any person/s (male or female) can reside in abroad say in USA, while a criminal case is pending in India. If so how to get that person back to India and make to present in Indian court/police? Who can do ? How ? please give all legal details with necessary sections of IPC and Procedures as per the Indian Legal System, and advise accordingly please. more

Sir, You mentioned that a "CRIMINAL CASE IS PENDING". If so, the court has its own procedure to bring the "accused person" before it. How can I know that there is a "criminal case pending against me somewhere in India" when I am working in USA? So initially a summons should be served to him. Make sure that you get his correct address and see that the summons (to appear before the court) is served to him. It can be sent by registered post or served to his relatives at home or if the house is locked, paste it on the door. If there is no response and if the case is not of a "verey serious nature", the case will go to 'LP' (long Pending) list and a warrant will always be there. Get his information and if he lands in India at any place, the police can pick him up and produce before the Court. Otherwise, you can watch the Vijay Mallya case!!!! more

It is totally depend upon the sanctity of your case, have you made any complaint to police against the person/s reside abroad. Firstly go to police, file a complaint against and then please come for legal advise.... more

Other things being equal,it is the type of case and the influence on PP,and the Judge that makes action. more

First you file a case and the court will take care as per law. Your advocate will look after all the issues. Don't jump to your own conclusions, it is very difficult to answer hypothetical issues. more
