One of my friend bought a 2nand flat @chennai at Annanagr 18 yrs old.hii is 2nd floor. Out of 8 apartments 3 are commercial g.floor. there is a self styled president secretary by rotation.
From the 3 rd floor 3 bathrooms there is water seepage into my friends 2ndfloor bathrooms and halls...when my asked about 3rd floor Kerala occupant that owner replied him you collect the the water & drink!?...my friend brought a well versed engineer to investigate the problem.the engineer confirmed the seepage from 3floor bath&wash to 2nd floor occupant...
My friend asked them what you have all done with the maintenance money collected?and refused to pay maintenance more than rs.1000/pm.
The other occupants supporting 3floor occupant!?and viseversa.....
They categorically told my friend its your lookout!?since its a flats inside job!?
If further questioned one of the flat owner comes in a drunken stage and absuses the 2floor flat owners wife!?and my friend.?who are senior citizens
My friend came to the park while walking and told this....these 4 flat owners will do anything?!
So I am posting this as a resource to the legal advisory&matters tobsuggest some solution.
It's seems now that the gang4 wish to start a welfare association and asking my walking friend to sighn the papers without any alteration and asit is. My friend says for all negleted repairs of 18 years like lift\weatheringcourse\pipelines replacements why should I pay equal share?!and divide any such expenses on pro rata basis of years of occupation ?!
The gand4 rulesout that suggestion in the articles&memorandum to be prepared...they ask my friend to sign in or suffer!?.
Can any retired judges,social minded advocates help my friend? By replying to this post and by mail so that I can pass it on to him!?

In flat system this is one of the major issue. The leaking bathroom and toilets need to be dug up and totally redone to stop the leakage from flat above. When we faced this problem in our flat we shared 50/50 basis the expenses for the top floor toilet and bathroom renovation. Though it is burden for us there is no option as bedroom and drawing room condition was pathetic. In many flat system the plumbing contractors deliberately leave the joints un cemented so that they come for repairs. more  
Mr Srinivasa Narayana is mixing two issues into one. The first part is the third floor bathroom leakage which is affecting his flat on the second floor. He should write to the association and point out the issue and insist that the third floor owner repairs his bathrooms. In case he does not get relief he has to approach a lawyer and issue a legal notice and if necessary file a civil case against the society and the third floor owner. I know it is time consuming and costly but to a non legal layman like me its seems to be the practical way to deal with the issue. The second part is sharing of expenses for maintenance. on this front legally speaking he has to bear his share of the expenses even though it may be for a period before he bought the flat. Non payment of maintenance will only weaken his case. more  
Gentlemen, we are aware that the objective of this group/circle is to get the inputs from the citizens as to their experiences about, and expectations from, the prevailing judiciary system of our nation; they propose to consolidate the views expressed here and take up with Law Ministry for their necessary action; We should work towards that end; Take the representations by Messrs Narayanan, Nair, Nagamanickam, and others ,these are the entry points for the present movement; For the moment these are only individual voices of disappointments and it becomes our duty to join with them and raise the decibel levels of the protest; And a responsibility is also placed on the elite of the legal profession to voice their opinions, guidance etc to the issues raised in the circle; I sincerely hope they would join the circle soon; more  
Since I was writing from my mobile I couldn't write much in my previous comment but I What I want to convey is that we need to regroup and help each other on every matter against breaking of law otherwise it has become a common notion to see that the other person is in trouble and not me and still feel safe. What the safe person doesn't realise is that the next target can be him/her and this will go on. The world simply runs on supply and demand basis. Dishonesty in everything is delivered because there is a demand for this dishonesty and this is vicious circle. Even a mentally honest person is drawn towards dishonesty due to this non-existence of resistance to dishonesty. This is a simple fact of society and so called peace loving people and feel-safe people are forgetting this fact and is resulting in the reduction of their numbers day after day. It has come to a point where we have no option but to tackle the raging bull of this social evil. Being a senior citizen you might feel less energetic to tackle this problem and by seeing this attitude other energetic people will also get a feeling of lack of motivation to live a better possible life. So my request is to at least make people understand that the dangers of not acting the problem is far greater and long standing than acting on it. Being a Senior Citizen you have seen a lot more walks of life and can definitely share with young people your immensely valuable basic knowledge about life. Hope everybody understands. more  
Dear Neelam Nath, I agree that I am not a senior citizen but my parents are and I thus can understand the inconvenience of a Senior Citizen. But one thing you must also realise that the strength of unscrupulous people comes from the display of weakness of the so called peace loving people. I realise that it is our duty as a good citizen to check time and again that the machinery of society is working with honesty and effectively to the well being of all honest people in the society and also providing opportunity to the unscrupulous people to get rectified. It is our simple negligence and complacency to perform this very basic but very very important duty due to which these anti social elements gain strength day after day. How long do you think we are going to live on this wretched life in India? It is high time we have to take this Bull by its horn and start to regroup ourselves against these tyrants. I am not a senior citizen, but when I will be I wish to die in peace instead of fearing for my kids and grandchildren. more
