Legal nuisence priblem
I am running an Industry & locked up in Legal Nuisence by some niscredents. He has posted some proofs un court & compnay alw board (CLB).
The proofs are old as 25 yrs. But is a sumbling block.
Is there such law which superceds very old complaints? more

The post was in Aug 15. Till Oct there is no CLB mem er in Mumbai. Date gone in Dec. A year wasted. May have to go to Delhi for justice. It's tiresome. Law is taking it's time I am harassed by the person who is using this delay. more

In one of the cases, CLB held that " It is true that the CLB is not a court for the purpose of the Limitation Act and as such the limitation under Article 137 of the Limitation Act, 1963, does not apply to the proceedings before the CLB, however this does not preclude the CLB from rejecting/dismissing petitions on account of delay/laches in appropriate cases. " more

Pl check if it is possible to get a stay on the activities of the litigant, and you be allowed to continue with your business without any hindrance from the litigants? It is not clear under which section of the Comp Act has the litigant filed the claim? And from the reading of the case, it appears that you are trying to shift from the premises and the litigants have put spikes etc to prevent your movement. Does this not call for a redressal through Police rather than CLB? more
