It is almost impossible to get satisfied judgement from court however the mediation and conciliation are the best methods of alternative disputes resolution mechanism to settle the dispute for ever. We should make efforts for community based mediation service so that pity issues which are faced in day to day life in our colony can be resolved amicably more

In the US (and other countries)..... they have a jury system..... giving "absolute powers" to arbitrator is prone to "corruption, compromise and conflict of interest". As long as jury selection is fair, transparent and open justice can be swift and effective. Are we ready to hand over justice to the aam aadmi or we still slaves of rulers...... for everything.....!!!! more

Dear Mr. Jaswant, I fully agree that mediation could be promoted as an alternative dispute settlement. But the ground reality is that mediation in the family affairs have been turned into an extortion centre. The objectivity of the mediation centre was to resolve the misunderstanding and put the best efforts in the matrimonial adjustment. However, the moment a case comes in the mediation centre, one ask husband how much money you would pay to wife for divorce and separation. The ethics of the mediator, the least is spoken the better it is. There was a mediator in Maurya Enclave police station in Delhi who used to bring her practicing advocate in most of the mediation proceedings so that she could pressurize husbands to engage her husband as their advocate to present in the court. Whole of Delhi Police, CAW Cell Nanakpura, DSLSA provided wrong information to the information seeker. I have assisted myself to the information seeker. She (Mediator) submitted a fake medical certificate proving that the husband was critically ill and was on bed. Now the question arises as to why this whole system acted in this particular fashion unless and until there is a financial interest. However, the name of the mediator, her husband and the relevant information will be shortly appearing on the public domain. In view of above, it is a good idea if the mediation proceedings is kept out of courts and advocates and should be entrusted to elders of social repute. more

I am handling various matters as Mediator in Delhi Mediation Centre for last for than 3 years and have experiences that the family matters becomes complicated when they reach at the hand of lawyers in court. At the initial stages of difference, the dispute can be easily manage by netural third party more

Dear Mr. Jaswant, While the mediation in the community issues like consumer issues, parking and other disputes could be a solution, the mediation process in the family disputes has been a utter failure. I have a suggestion that the mediation centres for resolving community disputes could be set up in the community centres manned by people of non-judicials but with a general background with logical conclusions. more
