RESTAURANTS HOTELS NOT BOUND BY LEGAL METROLOGY ACT AND COULD NOT BE PUNISHED - S.C. HELD THE VIEW.
Now the customers have to wake up to the prices of Mineral water seerved in Hotels and Restaurants. This may hold good for the other packeaged items like soft drinks and branded icecreams also .
There should be no moRe complaints about the Hotels selling over the M.R.P. We have to find the price before we order such items in future. Or go to hotels that charge less over the M.R.P.or avoid such products. more

The well taken Video attached by Ms. Swetha [posted on 14th Dec.] narrates the arguments between the consumer and the retailer causing discomfort and anger in the minds of the consumer . The Government and authorities shoould take up this matter with the court explaining the uncontrolled charges levied by the traders putting the consumers in distress. This price hike over M.R.P. should not take place in a sales counter as shown in the attachment. In case the water is served in a restaurant with Ambiance as mentioned by the Supreme Court , or served in a Glass there can be justification for selling over the M.RP. But now the ruling will be mis interpretted by the Traders to make profits. WHERE WILL WE CONSUMERS GO NOW ? UNLESS LEGAL METROLOGY DEPT. CHALLENGES THE ORDER OR BRINGS OUT NEW RULES WITH CLEAR WORDINGS SO THAT THE CONSUMER'S INTERESTS ARE SAFE GAURDED. more

For providing ambience we pay high cost for food and SGT. It is the duty of govt to amend the law. Courts are there to deliver the judgement by interpreting the existing law. So don't blame the court. more

If traders are allowed to sell over M.R.P. then the pracice of marking M.R.P. becomes meaning less. more

AGREED. LEGAL METROLOGY ACT SHOULD BE DISPENSED WITH TO PROMOTE THE PROFITS OF TRADERS/EATERY. more

The only solution is that Legal Metrology Act needs to be amended by Parliament as follows: 1. The definition of Sale needs to be changed. 2. The place of sale needs to be specified for packaged products. It should include Restaurants, Hotels, Cinema Halls and Multiplexes in addition to shops. more

The legal Metrology Act has already included hotels/institution which were excluding earlier.
Sale is defined when a person pays a consideration/money and get the product whether it is loose or packaged product and it is mandatory to issue cash memo for the price paid. more
