MINISTRY of CONSUMER AFFAIRS GUIDELINE to FAIR TRADING PRACTICES RELATING TO CHARGING of ....

SERVICE CHARGES from CONSUMERS by HOTELS/ RESIDENTS - Dated 21st April 2017 :
I am attaching this information after several posts from members with proof of charging S.C . so boldly by the Hotels in these two towns Noida & Gugaon which come under N.C.R.
also with a special reference to the posts of Mr. Ajay Dutta & Ms. Gloria Joseph.

TO THE AUTHORITIES :
Based on the attachment from the Department Consumer Affairs , Don't wait for a complaint from each Individual . We, the Minister and the P.M. have reposed faith on the Department to be alert and take action .
BETTER TO ACT ON THE COMPLAINTS IN THE CIRCLES & SEE THAT NO HOTEL & RESTAURANTS EXPLOITS THE CONSUMER AS BEING DONE IN NOIDA & GURGAON . more

The 5 guidelines given in the order empowers the customer enough to refuse to pay . The order says that the service charges are not mandatory . ( 1 ) Component of service is inherent of food and beverages served. Pricing of product is expected cover both food and services . (2) Order placed by customer is in agreement withe the prices mentioned in the menu with applicable taxes. Charging anything more would amount to unfair trade practices. ( 5) the bill may clearly display that the service charges is voluntary , and the column may be left vacant . On paper the Authorities have done their bit . They also wanted to maintain the relationship with the Restaurateurs. THE BALL IS IN THE CUSTOMERS COURT . IT IS NOT MANDATORY FOR THE CUSTOMER TO PAY , BUT IF THE CUSTOMER FEELS DELICATE TO REFUSE AT THE RESTAURANT SHOULDN'T COMPLAIN. more  
I agree with Mr Gurg ,service charge must be abolished. Charge per room and GST that is all. more  
Every restaurant should mention that they don't charge service charge otherwise license should be canceled more  
Service Charge must be abolished from the bill itself so as to avoid confusion. more
