Ministry of Law

Legal reforms are the real need of the hour in India. The active citizens of India (many here in circles) need to work with Govt and its Law Ministry and get the judiciary to take the common citizens's feedback incorporated.

My request to PM and his staff in the circle is to get a legal reforms circle where we can share whats needed and law minsiters team can take up these things.

2.5 years of this Govt are gone with no progress on this front and like this other 2.5 will also go away so high time we act on this.

I agree with Ms. Naina Mittal and Shri Valhuram Choudhary That reforms in our judicial system are the most urgent need of these times : in fact the reforms in the judiciary are OVER DUE. As a matter of fact, since independence hardy there has been any change in the judicial system except, perhaps the avoidance of the phrase 'my lord' and the periodical increases in the emoluments of the judges! NO OTHER BRANCH OF THE GOVERNMENT GETS SO MANY VACATIONS AS THE JUDICIARY : this used to be their during the British period when most of the judges, specially in the higher courts, were Britishers who did not like to stay in the plains and left for hill stations on vacations, liked to have a long Christmas and new year celebrations. There was a time when the entire British India Government used to shift to Shimla during summer. WHILE ALL OTHER BRANCHES OF THE GOVERNMENT OF INDIA HAVE DISCONTINUED ALL THESE RELICS OF THE BRITISH RAJ, whenever efforts have been made to bring about any change in this regard the Judiciary has resisted it vehemently. It was really very touching to see the then Chief Justice become so emotional about the delay in dispensing justice, but will some one tell how many case have been adjourned for years merely because the advocate of one of the parties to the case chose not to appear on the date of hearing? I am aware of a case filled by 5 pensioners against the employer and the government in the Supreme Court. The case did not come for hearing for quite a long time, when it ultimate did come up for hearing it kept being adjourned because either the employer's or the government's advocate or both of them did not remain present. Ultimately at the insistence of the plaintiffs advocate, the court made advocates of both the respondents remain present. In the meanwhile 3 of the original plaintiffs had died of old age. The Supreme Court now found that the case should have been first heard by the High court and remanded the case to the High Court with an order that the case be disposed of within 6 months. Quite q few years have passed since then, and WHEN I LAST ABOUT THIS CASE, IT WAS STILL PENDING HAVING BEEN ADJOURNED REPEATEDLY FOR THE SAME REASONS AS STATED ABOVE. SHALL I BE WRONG IF I WONDER I WHETHER WHAT IS BEING AWAITED IS THE NATURAL DEATH OF THE REMAINING OLD PLAINTIFFS ! Quite a few judges and ex-judges have repeatedly expressed about the short comings of the present system of the selection of judges. BUT WHEN IT COMES TO CHANGING THE SYSTEM, THEY REFUSE AND THWART ALL EFFORTS OF THE EXECUTIVE TO INTRODUCE CHANGE. PERHAPS IT IS UNWILLINGNESS TO GIVE UP ANY PREROGATIVES OR TO APPEAR TO BE COMPROMISING ON THEIR SENSE OF BEING THE MOST SUPREME. I HAVE THE HIGHEST RESPECT FOR THE JUDICIARY AND THIS IS BEING SUBMITTED WITHOUT ANY DESIRE WHATSOEVER OF BELITTLING THE HONOR OF OR CAUSING ANY ASPERSIONS ON THE JUDICIARY. But I do believe that changes in our judicial system are needed as soon as possible. more
Reinitiate the JURY system or have ever court & its proceedings captured and documented through CCTV etc. Courts are the real genesis of all corruption in India. Most judiciary and court officers in all lower courts are corrupt and the same should hold true of HC & SC but for big deals. You want to purchase a judgement for a few thousand bucks come to Bengal! more
