Misuse of Rape Law a social awareness

There can be new ways adopted by the law enforcing agencies and administrators that no sooner complaint is received against known persons and victim does not seems to be injured or traumatized,or if the complaint is pertaining older incidents of rape, the enquiries initiated and completed within 24 hrs by responsible official not below the rank of dsp.. who should give directions to local police to register or otherwise on the complaint received. Meanwhile, as done in USA and Europe, sanctions must be initiated against the alleged offender restricting his movements and that he should not be found in the vicinity of the victim say 2 KMs away from her home or work place till such time the enquiry is finished and he should report thrice a day in the local P.S. where he is residing. This will save honour of innocent persons dragged into foisted rape complaints. Code of Criminal Procedure is to be suitably amended giving directions to administrators and courts in the above manner. more  

Loopholes in the current rape laws should be plugged in. It should not be biased in favour of women only. more  

Media is the worst offender and law should be enacted against them similar to rape charges favoring women. more  

Yes , if certain law is made for the welfare of the people , then certainly some people try to use the same for themselves. Making false cases or misuse the law.But inspite of this there number is very small. It is pertinent to mention here that in our society the females are at the receiving end , firstly by dowry & burning cases, the law made to protect them were misused & with the passage of time the law became mild as was misused by lodging false complaint. Same has happened with this rape law, it is made with good intent , but misused by few for their benefits or settle some score. With time action against those misusing will be taken by courts. It already has started. more  

Then false notion of Empowering Women with Gender biased Law is creating an upheaval in our families and society. I will never say all the Women are misusing it, but a tremendously high percentage of fake cases; which are coming out in the open are the cause of concern. This coupled with people in the judicial system looking at it as a lucrative $$ making business is making situation worse, where girl and her family are lured to file such cases. On the marriage front 498a, DV, 125, even in Divorce everything is so biased that the Husband stands to loose a lot; be it monitory, or even on the personal front. Loss of job is for sure, social status( the girl is looked upon as the tortured Wife and husband n in-laws as the cruel and poisonous individuals that can harm any body) The way IrBm was going to be added up as amendment of the bill in case of Divorce was such a win win lottery for the estranged Wife that she could destroy her husband completely, with the money and share in the property she could walk away with. There were Divorce cases that were kept on hold as some people were expecting the bill to be passed. But luckily the current government asked for amendment to same. In certain DV cases despite the husband having paid the initial down payment and the loan all by himself, the wife forcibly gets right to stay in that property, and also prevent the husband and in-laws from coming near that property. Look at the irony in such matters, where sometimes the wife might be equally capable to earn. Now the man has to earn, take care of his parents, pay alimony to the Wife, stay in some rented house, be looked down by friends and society as a wife beater n so on..... Well Rape and Molestation is such a weapon that any girl can get anything she demands. Be it $$, property, settle for marriage, drive the in-laws out, teach her ex-boyfriend a lesson as both of them fought and decided not to be together, but now she is jealous and seeks revenge. To add to that Media is on a dangerous trend of ruining the man in such cases. The moment a girl says Rape, media brands him Rapist, tells he should get capital punishment, passes final order by the time the show or so called debate is over and sometimes after few days it comes out that the girl didn't want to pay taxi fare, or she brushed her car with the guy and they had an argument n so on. In some rape cases, after years at jail, the guy is found innocent. But by then everybody forgot the girl n the guy too. Now they have a new issues at hand; and more importantly nobody would want to say that ohh, 5 years back we branded that man a Rapist, but today he stands innocent after serving 5 years in Jail. One of the reason i see is there is no enough or rather equivalent punishment if such cases are found fake. If Rape case says 7 yrs imprisonment, then filing fake case should also get 7 years. Same way in 498a, DV, 377,376, 125..... the list is just endless.. And making law Gender Neutral, because in today's day and time everybody says Women Empowerment and Gender Equality. But what has happened is it has gone from Equality to Special Empowerment at the cost of pulling down Man. Just think what if Husband is slapped by Wife, hit by some dish on his face, which are pretty common many husbands might have gone through. What if a girl rapes a guy, molests him. There are no provision in Law where he can seek justice.. Can we give it a thought. more
