Mobile towers

Hi,
Can anyone please help me in filing an RTI application with HUDA to get mobile tower in my neighbor's residence removed. I have been writing to HUDA for more than a year now with no response

Thanks for reply. HUDA has got jurisdiction over the towers erected in HUDA sectors. There is a policy in place where as it is incumbent on the cell tower companies and the owners to get permission for erection of towers in the jurisdiction areas. This permission includes a report by competent civil engineer stating that the foundation and the building structure is safe and can take take the load of the tower including the high wind shear. I know t no permission has been taken from HUDA by the owner/ company to erect this tower. I also know that the building which is 18 years old has been designed to take the load of just 2 and one half story of construction and no body has tested the foundation and certified it fit. This is a grave threat on physical security of my house as well as my family. In spite of this no action has been taken to bring the tower down. This is so because the cell tower companies have money power to keep any action at bay. Since I have written number of times without any result, I feel an RTI application would not be out of place and hence my appeal for help. more

You should write to CEO huda for its removal. RTI can also be filed with PIO huda office to know with whose permissiin this tower has been installed. You can down load application from Rti website and send ti PIO with 10/- Postal order. more

Hi. HUDA may not be able to help you as they probably do not have jurisdiction over the use of your neighbor's property. Cellphone tower locations are probably governed under the Post and Telegraph Act of 1910 which is an archaic legislation that does not cover a number of issues in the modern world. There's a lot of ambiguity over where these towers can be located and whose permits are required. I understand that the tower companies only need clearance from the property owner and possibly the airports authority for height of tower. I think that the only approach is for you to ask your neighbor to terminate his/her agreement with the tower company and ask them to take the tower down. However, as your neighbor would be earning a good sum of money through rental - I do not see this happening. Worst case scenario - you would end up living with it for the foreseeable future - unless some other magical invention happens on communications technology that does away with the towers altogether.
