Nikahnama v/s pre-nuptial agreement
My question to the the leaned members of this forum is, if Nikahnama can find its legal validity for Muslim community, why can't Pre-nuptial agreement have legal validity for Hindu community while entire Hindu Marriage act is based on the oral agreement between husband and wife (Saat + paanch Vachan)? If oral agreement can find such a great importance that an entire act can be enacted, why can't Pre-nuptial agreement be made a legal entity for Hindu community while Nikahnama can find its legal entity for Muslim community. more

Dear Mr. UDAY GB, but Hindu Religion does not disallow prenuptial agreement. Therefore, why no validity to such agreements. Please share if you have any Supreme Court judgment approving prenuptial agreement. more

Judgments quoted are not relevant in the present context. Live i relation does not have any relevance with "Nikahnama" or "Pre-nuptial agreement", so also the rape charges. Legally all acts are strictly independent from each other more

Dear Mr. Atul Jauhari (Technocrat), As stated Hindu Act is for the Hindu people, so also the Muslim Law for Muslims. The Uniform Civil Code is not yet adopted in India but the each religion is governed by separate law. The provisions of each law prevails and govern. more
