I had booked a flat at Gurgaon in 2008. The builder BPTP has delayed construction. Since the flat is not 100% complete, they did not receive OC from Haryana Govt. Now after 8 years of booking, i have received offer of possesion with escalated price . Also, demand of balance 5% payment. If not paid in given time line they will charge 18% interest. What should i do? more
Pl. ref. various verdicts of the SC and HC to the effect. One of the matter is Unitech wherein the HC and SC not only prohibited but compensated to the Buyers even by auctions of the properties/fine/penalties etc. Same is the case of Bombay HC wherein the Directors of Kumar Builder developer was directed to pay, make alternate arrangements. You are having fir case to contest, subject to time, efforts and money. more
GTM agreements are generally totally in favour of the Builder. Probably in the Agreement you signed there is little scope to extract compensation. In one case against GTM builders in the Consumer court, no compensation was allowed on the basis of the agreement. However, the court ordered to hand over the flat within a fixed time period. more

Offering of possession without the occupation certificate from the competitive authority is not legal under the existing law.Please write to the builder that his action of offering possession without OC is illegal & you will take possession only after OC's copy is given & also demanding 5% money and increase in price of flat are illegal. If the builder don't agree then consult a lawyer alongwith other buyers and file a case in a Consumer Court. You will certainly win the case as facts are on your side. more
