I have booked a flat in Noida with Amrapali in Jan-2010 with the condition of completion of Flat in Mar-2012 and in case of delay, the developer will pay a penalty @ 10/- per sqft per month. The Project is delayed like anything. The builder has refused to pay even penalty. After a great discussion and follow up get ready to adjust the penalty only up to Sep-13. And after that referring to the order of NGT for skipping from paying the penalty. The Developer has issued the final possession letter even without completing the basic and essential requirement of a building in accordance with the Govt. rules and regulation. They are openly cheating the buyers and no one wants to go against them through law. All individual are aware that the case before the court will go so long and the buyer will be forced to pay EMI as well as rent. I am trying to file a case before consumer forum but little confused as very difficult to get a good and honest lawyer to fight the case against the builder. Noida Authority is also favouring to builder in not replying the RTI filed. There need to improve the law for consumers and should be fixed a time line. Hard and strict law on the Builders as well as Authorities who are involved with the builder for looting the public. more
