Ownership of properties and the proof of documents

Requirement of documentary evidences about ownership of property and legal heir document is very complex for someone to understand .

I had purchased a property in Mangalore city in the year 2008 and last year October I have sold it someone. However till today after 6 months the deal is not closed due to want of documents .
The buyer approached bank for loan and banks legal advisor reviewed the documents related to property . Legal advisor observed in the year 1996 (26 years back ) to the one who sold to me had these document missing :
- Death certificate of the then owner .
- Legal heir document

Surprising is that when I bought in year 2008 , I had borrowed loan and no one asked this document . Loan was sanctioned easily.

Now I am the one co-ordinating with original party who I never knew to obtain these documents from the party who sold in the year 1996.

Now some how managed to collect the document required for Legal heir documents . But the Tahsildar office located in the area is refusing to issue the legal heir document saying we are not generating . Go to court . Court says go to Tahsildar office. Like that drama going on. I do not know when the issue will be resolved.

Conclusion is that there is no clarity of documents required for buying of property. Also multiple documents having same information example

documents required as proof are :

- RTC,
- Property Card ,
- Legal heir document ,
- Katha ,
- Site single layout ,
- Encumberment certificate

Why does all these document required ? If all these are digitized and kept complete history of details in an system including history of owners of the site . same can be pulled out anytime. more

Many states including Andhra Pradesh, where I live, have neither a “Land Revenue Code” (where all procedures for maintenance of land records and the procedure to common man are codified) nor proper records. People here don’t understand “Property Card” and government can’t provide authentic record survey plans and depend on a concept called Link Document, which is the last registered deed. A property, which is inherited and has no transaction for last more than 30 years is extremely difficult to be sold. Municipal records, which are improper are not trusted. Overall, unless it is an apartment, for which builder has provided all records and executed the sale deed, transacting is painful. more  
If you are a law abiding citizen, all the problems are for you, .if a politician there are no problems at all. Just look at the people occupying the foot paths and doing business and making crores, no tax, no problems. more

We have worthless Land laws. Those who live many decades and their existence is questioned where as those who occupy vacant lands or otherwise get acceptance. more  
The documentation required for Property are very complex and rarely understood by common man. Digitization of ownership is a must. I hope Modi government will take care of this problem. more
