Payment by cheque

I have paid maintenance dues by cheque on the last date of payment. It was credited to the association's account at a later date. The owners association issued a receipt to me on the date it received the cheque. However, later it has imposed a fine of late payment for the days upto the date of credit made to Association's account.
My query:
Whether the date of handing over of a valid cheque can be taken as date of payment according to the existing law? more

Undoubtedly. The date of delivery of cheque would be considered as the date of payment. If, however, there is any rider, it could be date of realisation in the normal course. If the realisation of the cheque is delayed because of lethargy of receiver, the receiver of the cheque/payment would be responsible for the same. more  
Hello! Ashutosh Chakraverty , Sir , Your question is out of context because a Cooperative Housing Society does not fall under the Shops & Establishments Act of the Local , State and Central Governments as on today . You may say such a Society is a self-Government or even a self-help Group of Owners utmost. You may say such a Society is not a profit-making body and also , not an Office of Profit . You may say such a Society is looking after the interests of the equally-ranked & gender-free Owners' properties ( Houses /Flats/Apartments ) collectively called the Building / Society . You may say such Society is till recently not taken seriously for the purposes of Cooperative Housing Societies Act of the State Government , the reason being all occupying owners are inadequately knowledged about this Act itself for their severally differing academic & professional & personal backgrounds . No State / Central / Local Governments mark an official circular to Society Office for it is not an Office recognisable as an Office despite property taxes , non-agricultural taxes , Water-bills , electricity bills , registrations , leave-license executions and a host of many many legalised functions and figure works . At times , the Cooperative mindset also goes missing with substantial inward and outward consequences purely for personal traits in respect of sustaining the Cooperative Housing Spirit . You may say , interpretationally , Last Date is defined as the date in a Cooperative Society such that there is no harm whatsoever including monetarily till the last paise , to the collective interests of the Ownerships Society serving the burdens of the Statutory Expenses as well as non-statutory Payments, for the Owners , by the Owners and of the Owners . No Owner, male or female , should anticipate personal discretionary " Exceptions and Exemptions " out of the way of Cooperation in Meaning , Scope & Content such that either ready liquid spot-cash or other ways and means of remittances ensuring complete sense of " instant-cash " but not " Numerical-Tamasha- later-turn-spendable-cash " much before the respectable deadline [ THE LAST DATE ] arrives but not in a testing fashion, like your Question , as if it were a Banker' World of " Figure Works & Figurative Instruments " . Your Question might have born out of your sheer " Guilty-Consciousness " with feeling you know , you are doing something detrimental as an Owner yet you can defend it in your high spirits or your air of superiority complexes , which mightbe , due to male -female -partnerships in day-to-day living a Life , too ! more  
Normally the date of payment is taken as date of receiving the current dated cheque unless and until there is an explicit terms stating date of realisation as date of payment. In case it is not stated explicitly, date of receiving the cheque is considered as date of making payment. In the instant case, additionally the date of presentation of cheque itself has been delayed by the society unless and until it proves that the society presented the cheque immediately or the next working day of the bank. more
