PF contribution not deposited by employer

What is the step against companies who not only pay the salary but does not even deposit employer contribution in PF account since decades? more

Yes. Also file a criminal complaint. Check the annual /auditor report and if the auditor has certified proper compliance of statutory formalities,send a notice to auditor and write to CA institute to put pressure on the directors thru auditor. more  
Take the case to the Media. Send a physical mail to Arnav Goswami of Republic TV and attached copies of all documentary evidence. Your letter should be carefully drafted with an Appeal to Help. You can file a criminal case against your employer. You file a written complaint against your employer in the local police station. Please enclose xerox copies of your salary slips showing PF deduction and your employer’s name, address and, if possible, PF registration number. You can also take this up with the provident fund department by sending an email to cvo@epfindia.gov.in. To furnish a written complaint in your regional PF office, you can get the relevant contact details at http:www.epfindia.com. You can complain to the chief vigilance officer appointed by the labour ministry. You can email at cvo@epfindia.gov.in . You can approach your regional PF inspector for action against your employer. 1. Employer's Contribution of P.F. is payable on Salary Paid BUT, IF EMPLOYEE contribution was deducted . 2. When the Salary is not paid, there is no question of deduction of EPF and, remittance of P.F. to the Commissioner's Office. 3. First get the Salary through court of law proving your Attendance and work discharged demanding the Attendance Registers , Pay Sheets to the area ALC or District Labour Commissioner's Office . If Labour Officer Proceedings acknowledges your working , you can proceed direct to District Court for recovery and Salaries, pertinent other benefits AND, THE PROVIDENT FUND WILL GET DEPOSITED IF P.F. is set for deduction in such payment . more

it is very difficult for a hones and strict govt. officer to survive. Secondly, people talk about anything without knowing the facts. There are some officers are framed because of their honesty. Regarding non-depositing of PF by the company, complaint can be made to the commissioner. more  
While I agree with you, please do not make a wholesale condemnation. If it were true our country would not have made the progress that we are witness to. Let each one of us ask oneself how much one himself is honest and then blame others. Mal or corrupt practice is not confined to government employees only. It is prevalent in every sector.

Let us now confine ourselves to the issue raised by Anish Chatterjee viz non-deposit of PF deduction. There appears to be a simple and near fool-proof system. I would state it in brief here. Amend the Payment of Wages Act. It should be provided that every single employer even if has only one employee will have to make payment to the employee through Bank A/c. Example - I have a small stationery shop and I have employed one Prakash in my shop. I should be required to prepare a Paybill wherein I mention the ID (aadhaar card should do), name and designation of the employee. It will have column like Pay, allowance, overtime, etc. and on the other side various DEDUCTIONS like Provident Fund, Income Tax and so on. The Bill is presented to my Bank. Who would debit my account, pass on the salary to Prakash's Bank a/c and PF, Income Tax etc. would be transferred to the concerned department/authority. Neither me (employer) or the Bank would have any control over the payment or deduction made. Prakash would be supplied with a Pay Slip and at the end of the calendar year Annual Pay Slips--this can be done by me or the Bank (as a third party). This suggestion is in brief.
