With attached order.

NAA has passed a verdict recently on a complaint against a proprietorship Company for not passing benefits to Buyers after gst rate was reduced from 28 to 18%. Case no is 25/2018.

Product is Garnier Nat Shade 3 manufactured by L'oreal India Pvt Ltd. A penalty of Rs 3L plus is imposed on the Supplier for not passing on rate reduction benefits. Verdict delivered after verifying all Returns filed by supplier to GST .

Detailed verdict is available at naa.gov.in, click on Orders from menu, select order 25/2018 and click download. It will open up in a browser window.

It is worth studying or at least browsing thru. It gives good understanding on the ways NAA handles complaints. more

There should be a clear distinction between cheating (overcharging of taxes like GST, more than the prescribed rate) and unethically fixing of higher charges of a product/services at delivery point or ex-works point. Mind it, the overcharging of GST is cheating the consumers and should be dealt with under criminal laws and the recovered overcharged amount should be refunded to consumers or unidentifiable consumers in their Consumer Welfare Fund Account under Consumer Protection Act by the assessing authorities whether the Trade & Taxes Authorities in the States/the Centre or any judicial court under criminal law or any other law dealing with consumers. more

It is OK, but let there be direction that the the rate of GST (which is fluctuating frequently) be mentioned near the MRP, so that the violation in GST rate can be more prominent. more
