Premium Lake View Charge collected by Builder and now a building is constructed Obstructing the view

I bought a Lake Facing Apartment 2 Years before. Builder charged 700 Rs/ Sq feet and I paid 720300/= for Lake facing charges alone. Now a building is being constructed in the vacant land near the current project which will obstruct the Lake View. Builder has not taken any step to stop that building. In this case I want either the builder to stop that construction or refund the Premium Lake View facing charges charged by the Builder. more

The agreement enterded by you with the builder needs to be seen./If it says that the premium amount paid by you is for LAKE VIEW, You can protest. Otherwise, you can not more  
For the sake of few thousand saving, never book flat on an under construction building. If a buyer is cash rich, he can bargain and buy a flat of his choice. If a buyer depend on loan, then again, he can choose a flat, location and worthiness of the builder, seller and title of plot etc., and buy.In this case, report this fraud to RERA by registered letter, mark a copy to the builder. The whole matter with documentary proof to be posted in social media/. more

Hi Anand, you have not clarified whether the new bldg is being constructed by same bldr or any other ? Secondly, most important, do you have any documents from bldr that he offered you lake view flat hence premium charged and you paid? Taking it granted that you were offered lake facing flat, in writing you were asked to pay more, and same bldr now constructing new bldg to blocking view, YES; you have good chance to get refund of extra money plus interest and also for mental agony etc by approaching Consumer Forum. There is about 7 to 10 yrs before ( mostly Bomaby High Court ) a judgment on similar case related to a bldg near Harkisandas Hospital Churni Rd Mumbai, bldr advertised open sea view etc etc, then constructed new bldg which blocked old bldg' flat buyers not only view but natural air and light too. Please Do some more homework, if I find the judgment I referred, will post link on this group. more
