Ever since the Aam Aadmi Party came to power in Delhi with an overwhelming majority, a series of vindictive policing has been unleashed on the Party and its volunteers by the Delhi Police seemingly at the behest of the central BJP government which controls it.
Police is an integral element for the impartial conduct and deliverance of the criminal and civil justice system, but it is sad to note that in Delhi the defeated BJP in the National Capital through its leadership has used the Police force as an instrument to harass and tarnish the working of the ruling Aam Aadmi Party.
Leaders and Volunteers of Aam Aadmi Party since its inception faced vindictive acts by the Delhi Police under the control of central government. But it is reassuring to understand that the honorable courts have ensured that justice system is not hijacked by the BJP-Delhi Police duo. The courts have not just delivered justice but have also exposed Delhi Police through its orders.
A brief account of the various Judgments passed by the District and session courts, High Courts and Supreme Court.
On 24.12.2012 , the 8 Volunteers of erstwhile IAC ( India Against Corruption) movement during the Protest against the Brutal “Nirbhaya”rape were arrested firstly for the charge of causing hurt to constable Subhash Tomar and later on after his unfortunate death , Delhi Police charged them with offence of Murder. Court ordered immediate release of the IAC volunteers and Delhi Police conceded the mistake.
Again Delhi Police caught napping in case of brutal and inhumanely act of Sexual assault on 5 years old “Gudiya “rather acting swiftly on to arrest the accused, its one senior officer ACP B S Ahlawat caught on camera slapping a AAP female volunteer Beenu Rawat. Court came out strictly against the Police.
18 Volunteers protesting against police inaction in another rape in Gokulpuri Police station which includes 3 minors girl child were first arrested for charge of rioting and beaten brutally in custody .When we approached Hon’ble Supreme court, the court transferred the case to Delhi Police and observed that the beating of the volunteers was an excess of power by the Delhi Police and Violation of Human Rights therefore order the consideration on paying the compensation to the petitioners.
In the custodial death of the Shehnawaz Choudhary in the Nand Nagari Police station, High Court Order a Slap on the face of the Delhi Police, How an innocent person was killed in the Police station and later a farce investigation was conducted to save the culprits, the AAP approached the High Court and the Court came to the rescue.
During the Hearing of Manoj MLA bail order and granting him the interim bail, the court in its order expressed the concern how the Delhi Police has a prejudice against the AAP.
Rohini court conducted the trial on day to day basis and finally acquitted the MLA of AAP from Model Town from all the charges and while passing the Judgment court observed that Police failed to establish a single charge as alleged in the FIR.
The Delhi Police showed unnecessary hurry and promptness to cause the arrest of MLA surendra Singh in a false FIR registered by some NDMC staffs and other person.Court exposing the ill intention of the Delhi Police , not granted bail to the MLA but also denied the request of the Judicial Custody to Police and order the immediate release from the Court only.
In the case of merciless beating of the volunteers of youth wing in Anand Parwat Police station, we are in High Court, the petition is pending.
On all the above counts, Delhi Police used its arbitrary powers of Policing against the Aam Aadmi Party and its Volunteers. Aam Aadmi Party notes it with dismay that the BJP leadership in Centre has been shamelessly using its police to demoralize the Aam Aadmi movement in the country.
The Party reiterates its commitment to stand by the common man and seek justice for everyone even in the wake of an adverse police system in the National Capital Territory. The courts have been instrumental in ensuring that a Police do not go berserk and victimize the common man. more
