Property registration in Delhi

I have come across a case which is quite interesting and is thus sharing for the information of the members as well as seeking views. The case is as:
A person has purchased a property a LG flat in Narela at a cost of Rs. 18/- lakhs and is wanted to get registration of the property done. The circle rate for the said property in Narela has been notified with a value of RS. 37 Lakhs. Now the Sub-Registrar (Narela) Alipur VI B, Delhi is asking him to pay stamp duty for registration of a LIG flat at Narela on the basis of circle rate Rs.37 lakh as notified by the government whereas he is willing to pay the stamp duty on the basis of market value of the flat Rs.18 lakh at which he has agreed to buy the said LIG flat from the seller. Sub-registrar is not willing for registration unless the full stamp duty is deposited as per government circle rate which is more than than double the purchase value of the flat. His demand for stamp duty on double the sale/purchase amount seems to be not justified and seems to be illogical also. Accordingly he has complained to the authority and the response of the authority is quoted as
" The stamp duty chargeable on a Sale Deed is according to circle rate or the actual consideration whichever is greater. In Narela 05 stories DDA flats the circle rates value are approximately 36,90,000/- and the actual consideration value is lower. Hence the stamp duty chargeable is according to circle rate value."
In my view the demand of the stamp duty on the circle rates in such a scenario is not correct as the cicrle rates in the locality has been fixed at almost double the price prevailing in the market. What are your views on the subject please. more

Come on, let's be practical about it. Sales of a a property UNDER the circle rate would be viewed with a critical/suspicious eye.. more  
As per law, stamp duty is on the circle rate or consideration whichever is higher. So Sub Registrar is justified in his action. It is for the Govt. to consider and roll back the circle rates. more  
I feel that this is the right time the Government has to revise the circle rates. more  
You have not presented full facts. Is Rs, 18 lakhs total cost or only the quantum paid in "white"?? more  
Feel it is a case for revision of circle rate. Fact remains that market rates of properties have come down in allmost every city / area. Govt must review and revise. more
