Real Estate Dev offering possession without comple
Can a real estate developer company offer possession of plots to allottees without getting completion certificate for the township from Government Authorities. One of the Company has offered possession of plots to allottees without getting completion certificate from Director Town & Country Planning and even started charging holding charges on account of not taking possession within 90 days of offer of possession. I hope in the RERA rules notified states that its mandatory to get some sale authorization letter if a layout is being developed similar to kind of occupancy certificate. Many a times earlier the builders form a layout and sell sites and when you ask them for approval from responsible authority they say they have to jack the price if such approval is required so alternative is considering that " Iam carving out a plot from this much X acres and selling to you as individual plot" Most of the population is not aware of the rules and fall for the trap so best way is to detect in registrar office and stop it. You should go through the terms and conditions of Sale/Agreement to sale. If the terms and conditions permits this, you have to challenge the same and get it quashed through Court of Law. And if the said terms and conditions does not permit, in that case you can approach to the Consumer Commission along with Civil, Criminal and other remedies. more
