recourse if management of housing society is unres
we are in a housing society in hyderabad.The management committee refuses to call for general body meeting.Members are feeling helpless.What is the recourse available to members in such situation? more
Please obtain a copy of the Memorandum of Association and Bye laws of the Society. Also list of all the Members of the Society. If the Committee members do not give you the details you could obtain it from the Registering Authority. After going through the same, studying the strengths and weaknesses of the present Committee members you should consult other members and enlist their cooperation in seeking early meeting of the general body specifically to elect fresh members. If the Managing Committee does not cooperate you should approach the Registering Authority. Please go through the Bylaws of the society. If the provisions are there ,The management has to call for special GM of as scheduled. If provisions are not there approach the Directorate of the registrar of Societies and ask for amendment to the Bylaw.Certain % of resident must agree. You have not Clarified whether r you are a resident or tenant . more
depends on your society registration. If it is under SOCIETIES ACT then 10% signatures are needed to call for an EGM. If President does not do so in one week, send your signed petition to Registrar of Societies in your town or region. Follow up by meeting him as a team. In the EGM ordered by the Registrar you can vote out the current management and re-elect a new BOM. the process will take u 30 days . more
There must be a provision in Memorandum of Association/Artcles of Association of the Society for caling a Special GBM in a situation like you are facing now. Kindly follow the procedure and do the needful. more
