If after sending notice, the documents are not returned, This is not on any institution but a group of people. What are the sections under which the court(s) can be approached. Are there specific sections for document recovery? Or are there general guidelines? more

You could send a legal notice to return the certificates unauthorisedly held by them and intimate them you would taken legal action for their recovery and all costs. In today's Times of India, a young girl has won her case against a medical college for recovery of her certificates from them when she discontinued the course due to illness four years ago. The judge has chastised the college since there was no mention on their prospectus that full fees for the entire course would have to be paid if any entrant drops out in the middle. IF THE PROFESSIONAL INSTITUTE IS SOMETHING LIKE ICAI, ICSI OR ICMAI, YOU WILL GET THE DUPLICATE WITHOUT MUCH HASSLE ON WRITING TO THEM. EVEN THERE SHOULD BE NO PROBLEM AS REGARDS, IITs or IIMs OR ANY SUCH PREMIER INSTITUTES. AS REGARDS EDUCATIONAL INSTITUTES, YOU COULD WRITE TO CONCERNED REGISTRARS OF THE UNIVERSITY WHERE YOU WOULD HAVE UNDERGONE COLLEGIATE EDUCATION. AS REGARDS SCHOOLS ALSO, MUCH PROBLEM IS NOT EXPECTED IN MOST PLACES OF THE COUNTRY EXCEPT VERY FEW STATES. more

Send them first a speedpost notice to return your documents and in case they do not reply please send a second FINAL notice stating if the same is not done in 10 days you will approach the court of Law and seek additional damages caused due to the delay in deliberation . more

Mostly IT companies do this.Thry also extract a bond for __ years service and do not mention, why this necessary. They collect the cert and hold you to ransom. The Govt on info from the aggrieved must ask the police to get the cert from the company. Alternatively, the Govt may also ask the Univ/College to issue a duplicate, with a note therein, that this is in lieu of the original illegally withheld by __company. This shd happen within 15 days of reporting by the employee. A stern warning to companies, not to indulge in executing bonds on plain or stamped paper is also necessary. Even Air India , asks for a bond without mentioning the reasons for it. They just hold the employee to ransom. I am in a fight against this bond. Yes, Govt must step -in. 16/4/18 more
