Refund of amount paid in under construction property
I have paid 30 % of amount for an under construction property but agreement papers are yet to be signed. At present my financial position is bad and I cannot pay further amount . I want to get refund of money paid by me. Please advice me how to move ahead. more
Trust you have registered agreement with builder. It is very hopeless situation. You are at the mercy of builder. You have to get your money back by either threatening him if you have that muscle power or by appealing to his conscience. Unfortunately most of the builders have no conscience more

No, a legal option is not the correct thing to do at this stage and neither is it desirable because it will serve to offend and antagonise the builder. The first thing to do is check your Allotment Letter carefully and read the terms and conditions contained therein and see if there is a clause which enables or entitles you to cancel your booking and what is the interest or penalty that would be levied. You may need to seek the help of a legal person for this. THEN you should approach the Builder and explain your circumstances and ask him to find a way out. See how cooperative he is and try to find an amicable solution. more
You will have to communicate to the builder of your desire to cancel the booking and request for refund of the amount paid by you with or without interest, as you may deem fit, within a time frame, say 15 days from the date of your letter of receipt of the same by the builder whichever is earlier. Should the builder be a good person, he may refund the amount with or without interest, perhaps he may try to negotiate with you also. On receiving his reply/no reply, send a reminder and subsequently you may file a complaint with the Consumer Forum under CPA. more
