Refusal of claim under travel insurance
My wife and myself travelled to USA on 06 May 2016 initially for 45 days and my travel agent who is also an agent for the above offered to arrange for travel insurance policy. As the time was short I agreed and asked him to take the policy for 2months and paid Rs.9000 for both.the policy schedule was revived by me on 6th when I was in airport. When I went through the same I found it saying policy valid till 21st June or return to indiaby the insured and the premium payment was shown as around Rs.7800/-. No application was taken by the co from me for the policy. We proceeded and unfortunately we had to extend our stay by a week. It so happened my wife fell sick and had to be admitted the hospital there. The authorities asked for insurance policy and on seeing the same they accepted to extend the treatment. The total expenses was approximately Rs.165000 and on claim by the hospital, the claim was rejected . Meanwhile I returned to India. On coming to understand that there was some problem for the hospital authorities to reach the insurance company I preferred a claim. After around three months the claim was rejected on grounds the policy had expired. I protested informing the company the terms of the policy is 21st June or date of return to India. The co rejected saying the validity of the policy is 21st June or date of return to India whichever is earlier. However I reiterate the words whichever is earlier is not there in the policy. I took up the matter with insurance ombudsman who after hearing the case decided that the co is at fault in not sending the kit detailing the policy terms and conditions and also agreed that furnishing the term of the policy from 6th May to 21st June or date of return to India (without adding whichever is earlier) has resulted in this situation. Though he found recorded the above, he had also said that even if the insurance co has not sent the kit, I should have asked for the same and hence I failed in that count. Though he has accepted my arguments and agreed that the hospital authorities in a foreign country also understood the terms in the same way I did, instead of awarding full claim or at least a reasonable claim for the mistake at my end, he awarded only Rs.15000/- without any basis against a claim of Rs.165000/-which is really surprising. I have refused to accept the same. I have decided to take a legal route for redress all of my grievance. Meanwhile having come to know of this circle, being a member of the same, I am posting this. I request the members to be aware of the above insurance co and suggest not to obtain any policies from them. Meanwhile I also request the circle to redress my grievance, if possible and I am prepared to provide any information that may be needed towards the same. more
