Rental Agreement -Tenant is threatening huge amoun

Hi All,

I would like to seek clarification on the tenant-Owner Issue. I have a small shop in a town called Bapatla Guntur distirct(A.P) . Tenant has been staying there in the shop for the past 14 years now and he is paying 10,000 now . We have a rental agreement which expires every two years .But, we keep reassigning to the same tenant every two years by extending the bond and signing the contract for the next two years.He never had the habit of making the payment on time .After 14 years of harassment we decided and asked him to vacate the place . He is trying to threaten saying he needs 5 Lakh rupees to vacate or else go he is asking to go to court. The latest contract got expired in august. We are very reluctant to sign or extend the agreement any more and I don't want to approach courts also on the same matter as they take years to resolve the issue and meanwhile the tenant will enjoy the property.which is of not to my interest.

Please suggest me a right way or a realistic way to address the issue.

My mother experienced similar fact.... Then she went to court and file case to vacate the tenant..after five years .. ..waste of time ....the tenant got decree in his favor that he has the right to continue... The biggest fact behind the case was that.. the tenant himself admit that the paid bribe to get the judgement.... My suggestion... dont waste time,,, as we lose in front of law more  
Since he has already told you that he is not going to vacate, you may have to give a lawyer notice along with police action after that. You can give the lawyer notice one month before the current tenancy agreement ends. This always shows your readiness to go to court if needed. more  
Rental Laws vary from state to state. Please first check with the local rental laws & regulations before proceeding. In some states you can give one month notice for vacating through court order also. In other states, past records will be scrutinised before giving any judgement this way or that way. more
