Result of reservation - creation of new social groups

We have to support S.C. on many issues they directed. Main is this Uniformity. A.After facing above 3 decades Women and Child menace S.C. directed the Prime Minister Narasimha Rao to take fresh look at Art. 44 of the Constitution which enjoins the State to secure a uniform civil code which , accordingly to the Court is imperative for both protection of the oppressed and promotion of national unity and integrity. Concluding the case [1995] 3 SCC 635 , S.C. referred 4 petitions and narrated the issues where Women and Children were suppressed or oppressed . This petition, SCC 635 : The first petition was filed by a registered society working for the welfare of women and public interest litigation in the case of Sarla Mudgal where her husband solemanise a second marriage after conversion to Islam. 2.The second was filed by one Meena Mathur. She contended that she was married to one Jitendra in 1978 and they had 3 children out of the wedlock. In 1988 her husband solemanised second marriage with one Sunita Narula alias Fatima after they converted to Islam. 3.In the third case, Sunita alias Fatima contended that that after marrying her Jitendra Mathur had again reverted back to Hinduism and leaving his first wife. Her Grievance was that she still continues to be a Muslim but not being maintained by her husband and has no protection under either of the personal law. 4.In this case, Gita Rani contended that she was married on Pradeep Kumar according to Hindu rites in 1988. In 1991 she came to know that her husband ran away with on Deepa and after conversion to Islam married her. 5. petitioner Sushmita Ghosh Contended in the court that she was married to G.C. Ghosh according to Hindu rites in 1994 but in 1992 her husband told her that he did not like her and he would embrace Islam and married one Vinita Gupta. She prayed that her husband be restrained from entering into second marriage with Vinita Gupta ... ... The judges concluded and said that Article 44 is based on the concept that there is no necessary connection between Religion and Personal Law in a Civilised Society. Marriage, succession and like matters are of a secular nature and therefore they can be regulated by law. They also declared that no Religion permits deliberate distortions. B.The Religious Conversions thus ruined many Families irrespective of Religions and Castes . Real Citizen who had converted to these Religions for Faith, belief , follow had been sincerely continuing with the Faith belief and follow adding that Religious name after the original name of Birth. [We see many names] C.Many have converted either to Islam being afraid of cases under Bigamy ; Many have converted to Christianity for Food and Livelihood besides the Status of Money and Management . Those converted for these benefits AND NOT FOR THE CONSTITUTIONALLY ALLOWED human causes of Faith, Belief and Follow an opted Religion of his right have been creating lot-many issues of disruption, distortion, and also planting and instigating many in the Society . They are also creating many rival issues in the Communities and even Religions AND NEED TO BE PUT TO AN END REFORMING SUITABLY . more  

Now , we need caste free and class or category free society . By law , there should not be any discrimination through treating people with Religion caste category class etc . We have no ideal system which is required . more  

It is a true statement. But the truth among truths is that the fight is for the government administration, which was refused to certain communities for a longtime. Even now only three major communities/caste groups predominantly rule TN/represent people in the assembly which everyone can understand. There are plenty of communities without representation in the assembly and parliament. The struggle for political/administrative power will go on for ever and there is no one-line solution for it and it may continue till a caste-free society is formed. more
