Road Accidents

When a minor accident happens on road particularly involving a two-wheeler and a pedestrian, most of the time it is construed that driver is at fault. Even if a pedestrian jumps over a road divider and suddenly comes in front of vehicle mostly it is the driver who suffers either through police or through pedestrian. What is the law in such cases? Can people be made aware of this?
Recently I came across one case where a light push by a two-wheeler going at a jogging speed, resulted in pedestrian fall down but with no injury. The person got up and could walk without any problem. But that person incidentally being a relative of police personnel, very easily made the biker to give him Rs 3000 just for nt going to police station. more

If he goes to the PS he has to spend more and face harassment by the staff stationed there.Some times he may have to get blows. more  
Most of the accidents are due to sudden movements of pedestrians in the axis of the driver crossing the line of travel. Nexrt common cause is the lack of driving in the lane system mostly by two wheelers ,and a few motorists.Signalling by indicator in advance as to the direction /lane he is taking Will give sufficient caution the person behind to stay away or overtake .This is very important to follow lane system driving. J driving is not acceptable . The rule is that any body hitting you from behind is wrong.but if no damage to body or property it can be condoned by just oral apology .No black mailing is accepted. more

( 1 ) - Dear Mr. Ranga Rao, your point that the scooter driver should not have submitted to the blackmail and gone to the police station is correct in one way but do you realize that in actual practical life this driver would have been alone to face the unruly public and the torture he would have received at the police station, eye witnesses would also quietly walk away without offering any help. As this is the law of our land, this driver would have had to shell out money everywhere to save his neck, time & harassment. Road usage safety classes have to be conducted once every week, from school, college, business establishments and all government departments. The traffic police has also to be taught how to control traffic honestly and actively. Last but not the least Cell Phones not to be used by drivers, and the police when on duty. ( 3 ) Dear Ms. Hina, Correct no one obeys to any traffic rules ( neither the road users & nor by the traffic controllers ) everything is left to god to see. The heavier vehicle is taken to be at fault. ---- If things are not brought under control --- GOD SAVE THIS COUNTRY. --- Look at a small country like Singapore or a small place like Bali in Indonesia and see how they move. more  
The driver of the scooter should not have submitted to the blackmail of the pedestrain. Instead, he himself should have gone to the PS and lodged a report on the incident and a complaint against the pedestrain's bullying. Then, the matter would have been sorted out amicably without any loss to the scooterist if his version were to be true. more
