RTI Act

My father is a retired grade 2 zilla parishad headmaster of vijayanagaram district. He had retired in 1999 as per the vaguely available details with me. Now he had abandoned 9without legally separating) my mother to her fate due to the wrong misintertapretation and feedback given to him by inlaws when I was of 6 years age. Now I am 37 years age. I had filed an RTI on behalf of my mother on her name asking for my father's service records and pension details. I had not received a reply. I had filed first appeal, then I had received a letter from first appellate authority stating that since the service records are of personal nature as per section 8 (1) (i), they cannot be disclosed to any third party and also since my father retired in 1999 the information cannot be retrieved. Also they had asked me my father's pension number or from the school which he had lastly retired, so that they can pull out the details. Here, sirs please advice me the following :

1. Whether I should reply to the first appellate authority only from which my mother had received a reply or else shall I address the reply to second appellate authority. If so please let me know the second appellate authority (The initial rti application was filed with PIO, District Education Office, Vijayanamagaram district, Andhra Pradesh. The first appeal was filed with first appellate authority, district education office, vijayanagaram district, andhra pradesh, from which I had received reply which is not satisfactory and insufficient)

2. Will myself and my mother considered as third parties for disclosing such information ?

3. Please advice me how, when and to whom I should file reply for the above letter received from first appeallate authority and what all sections shall i mention in that reply to retreive my father's service record and pension details on behalf of my mother ? I am filing using her name only ? more

1. All details provided by you are Oral and hear say. One Must go with documentary evidences to make it full proof. For that you have to obtain relevant doc.'s. 2. You and your mother can not be considered as third party. Go with relevant documents and re-approach. 3. The Authority responded will give you the relevant details of filing Second Appeal. Else you can approach to HC with writ so to save the time, Money and efforts. more  
Pls check the reply to the first appeal. If the same is for disposal, you need to necessarily approach the CIC which is the second appellate. That is the prescribed channel. Do not get misled into going in to any court for the purpose of reply to your RTI. If the reply of FAA is not a disposal but merely asking clarification so that he could answer your appeal, pls provide him with details. more  
THE BEST AND EASIEST WAY TO GET EARLY RELIEF YOU HAVE DIRECTLY APPROCH TO THE HIGH COURT PRAYING TO GIVE DIRECTIONS TO THE PIO, District Education Office, Vijayanamagaram district, Andhra Pradesh TO SETTLE THE MATTER AT EARLIEST DUE TO OLD AGE OF YOUR MOTHER AND HER STARVATION WHICH LEADS HER IN WEAKER CONDITION AT LAST DAYS OF HER LIFE WHEN HER HUSBAND SERVED THE NATION TO BUILT UP THE FUTURE OF STUDENTS. more  
Non providing the requisitioned information urged is persistent decades only with the view to reduce further increase of created injustice ; legal cases on the Governments even in the exercise of Constitutional articles & other Laws . Keeping away the public from the ease & reach of legal Justice through Courts even where the public interest oriented Constitutional articles like 32 , 39 A , and even 226 are in Force to enforce , is also willful at the undemocratic rule by the Politicised public administration . This issue is energizing all the political parties to miscarry the articles and laws at the cost of the poor Citizen paying taxes to live . This attitude of Governments must be changed with necessary Reforms in various Laws and Articles on which only the politicians are playing with the very lively-hood of the Indian Citizen . Though it is known to many individually could not and cannot step up to various reasons and hence , a Separate Circle to Redress Public interests & Grievances is absolutely needed to be able to achieve finally the goal of good governance . I once again request the Indian Legal Circle to think on this prime issue that can redress and address the many public ills & Grievances . more
