We are staying in Indore in same Flat/Room from last 15 years,on Rent ,there is no dispute and everything is alright till yesterday, yesterddy our owner came and asked us to vacant the flat, without giving any reason. Kindly guide me what is the law to make the Rentee to vacant the room. more
Normally house portions are rented by the house owner if he finds he is in need of money for say maintenance of the house or his income needs to be supplemented or other personal reasons. He could be a senior citizen also. Generally after marriage only majority of the persons build a house. It is a gentleman's agreement that the tenant vacates within an advance notice of one month. This is true for the tenant also. if he wants to vacate he can give one month notice to the house owner. Having regard to the comfortable living the house owner provided you it is a good gesture you agree to vacate the premises . A person who allowed you to co-exist in his house without any worry surely must have a reason for requesting you to vacate. You are a tenant and now the owner requests you to vacate. Please oblige and help him. more
"The owner has right to ask you to vacate the flat" in legal manner and with due procedure of Law and NOT by coming one sunny morning asking to vacate under the pretext of Own Use which he had not used since several years (15 in present case). This is a good example of our Social System. more
Do you have a valid tenancy rent agreement in place ? If yes, owner has to give you advance notice as per the rent agreement. But if you don't have a valid rent agreement in place, you are an illegal occupant and owner is entitled to get his flat/room vacated without any notice. more
